Dear Mr. Sharpe:

i I am writing in response to your March 16, 1981 request for infomation regarding responsibility for mintenance of the Public Emergency Alerting System in the environs of the Maine Yankee nuclear power plant.

NRC policy on respor.sibility for early notification to the public is addressed in 10 CFR 50, Appendix E.Section IV.D.3 which states, "By July 1,1981, the nuclear power reactor licensee shall demonstrate that administrative and physical means have been established for alerting and providing prompt instruction to the public within the plume exposure pathway EPZ". The intention of the regulation is that such alerting means will be provided throughout the lifetime of the plant. The regulation does not specify the financial responsibility for installation and maintenance of any particular type of equipment. However, as a practical matter, the nuclear power plant licensee has an interest in assuring that the system is maintained throughout the plant lifetime. We understand various funding arrangements are being worked out at other nuclear power plant sites but have no specific information on these.

However, as a practical matter, the regulation quoted ha.s~ the effect of placing the burden for main-tenance of the system throughout the life of the plant on the nuclear power plant licensee. This has been the experience at other nuclear power plant sites.
