This is in response to your request dated October 26, 1984, regarding the return of two boxes of fuel pellets to General Electric.
We have reviewed your request and have determined that granting it will not adversely affect the common defense and security nor the public health and safety and is otherwise in the public interest. Accordingly, we are issuing a new uanumbered license condition to Amendment MPP-3 to your License No.
SNM-1168, effective immediately, to read as follows:
Notwithstanding the requirements of 10 CFR 70.58(e) and (g) for the receipt and shipment of Pellet Box Numbers 3226ZZ0202 and 3226ZZO203, the licensee shall follow the attachment to its October 26, 1984 letter to W. B. Brown for the receipt and shipment of the two above listed pellet boxes.
We have determined that the attachment to your letter dated October 26, 1984, contains information of a type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be commercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
