Dear Messrs. Kohn and Condit:

This is in further response to your letters of April 9,1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), various categories of documents relating to Dow Chemical Company of Midland, Michigan.

Listed in the enclosed Appendix F are additional documents subject to these requests. These documents, like the ones covered in my letter of May 29, 1985, refer to Dow Chemical Company licenses which have expired. We are placing copies of the records identified in Appendix F in the NRC Public Document Room (PDR), 1717 H Street, NW, Washington, DC 20555, for your inspection and copying. You may obtain access to these records by presenting a copy of this letter to the PDR staff or by requesting the PDR folder with the F0IA numbers listed above, under your name.

Portions of each of the documents listed in Appendix F are being withheld from disclosure pursuant to Exemption (6) of the FO!A (5 U.S.C. 552(b)(6)) and 10 CFR 9.5(a)(6) of the Corrnission's regulations. The information withheld consists of home telephone numbers and other personal information the disclosure of which would constitute a clearly unwarranted invasion of personal privacy.

Pursuant to 10 CFR 9.9 of the NRC's regulations, it has been detemined that the infomation withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons re-sponsible for the denial of the information are the undersigned and Mr. John G.

Davis, Director, Office of Nuclear Material Safety and Safeguards.

This denial may be appealed to the NRC's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations U.S. Nuclear Regulatory Comission Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."
