As ciscussed with you by telephone on April 27, 1931 during the course of the neeting that date on EC!iP's proposed cententions, enclosed are cacers which would be filed with the Board indicating EC:!P's withdrawal of its proposed contentions 2 and 5. The papers included are:

- Stipulation Pegarding Settlecent of Issues;

- Joint ::otion to Approve Stipulation; and

- Order Crantirg Joint ."oticn to Approve Stipulation.

As you can see, Fox Trcubridge has executed the Stipulation and Joint l'otion on achalf of the licensae and I have executed then en behalf of the frC Staff. It only rerains for the Stipulation and Joint l'otion to be signed by you cn behalf of EC::P and then the papers, including the proposed Order which I draf ted, can be transmitted to the Roard.

l STIPULATION REGARDING SETTLEMENT OF ISSUES For the purpose of resolving Contentions 2 and 5 asserted in intervenor Environmental Coalition on Nuclear -Power's ("ECNo")

" Supplement to Request for Hearing," dated June 23, 1980, but not yet admitted as contentions in this proceeding, the licensee-(Metrocolitan Edison Company), ECNP, and the NRC Staff hereby stipulate as follows:

1. In consideration of tne infonnation supplied to it by the Licensee and Staff at the meetings held on July 11 and August 18, 1930, as documented by the diagra attached to the letter of October 10, 195:

to Dr. Johnsrud fro.- Ms. Ridgway (cocy attacned), ECNP witneraws its proposed Contention 2.

2. In consideration of the modifications of Proposed Technical Specifications 6.10.1 and 6.10.2 ef fected by the Amendment c# Orcer dated April 28, 1980 and the licensee's further stipulation that it will turn over to any successor licensee of TMI, Unit 2 the records recairet to be maintained by Specifications 6.10.1 and 6.10.2 (witn resce: to Specification 6.10.1 :nis oblige!!:r. : hall be limited to those re:o :s i for which the five year retention period has not yet expired), ECN:

withdraws its proposed Contention 5.

3. No amendnents to the license for TliI, Unit 2 or the Procosed Technical Specifications attached thereto are necessary to effectuate tnis stipulation.

Dear Judy:

At the July 11, 1980 meeting of Licensee, the NRC Staff, and the petitioners in the TMI-2 OLA proceeding, one of Licensee's technical representatives diagrammed the TMI-2 boration control system for you, in our discussion of your proposed contention 2. In light of the diagram, you stated that you were considering withdrawing that contention.

At our August 18 meeting, you stated that you were withdrawing your proposed Contention 2, but requested a copy of the diagra.m for your records. A copy is here enclosed. Please note that the diagram is at the same level of detail as the diagram drawn at our July 11 meeting.
