APPENDIX NOTICE OF VIOLATION Pittsburg-Des Moines Corporation Docket:

State of California 0617-34 NRC License: General Based on the results of the inspection conducted on May 21, 1985, and in accordance with the General Statement of Policy and Procedure for NRC Enforcement Actions, 10 CFR Part 2, Appendix C (1985), the following violation was identified:
10 CFR 150.20 requires, in part, that any person holding a specific license from an agreement state is granted 6 general license to conduct the same activity in nonagreement states provided that he files copies of Form NRC-241, " Report of Proposed Activities in Nonagreement States," and copies of his agreement state license to the appropriate NRC Regional Office at least 3 days before engaging in such activity.
Pittsburg-Des Moines Corporation submitted such a report dated February 14, 1985, for proposed radiographic activities to be conducted in Rock Springs, Wyoming, during the period April 15, 1985 to September 15, 1985.
Contrary to the above, on May 21, 1985, the NRC inspectors determined that Pittsburg-Des Moines Corporation possessed and used a radiographic device containing 52 curies of iridium-192 in Rock Springs, Wyoming, during the period March 15, 1985 to April 14, 1985, a period that was not indicated on the NRC-241 form.
This is a Severity Level V violation (Supplement VI).
Pursuant to the provisions of 10 CFR 2.201, Pittsburg-Des Moines Corporation is hereby required to submit to this office, within 30 days of the date of this Notice, a written statement or explanation in reply, including:
(1) the corrective steps which have been taken and the results achiewd; (2) the corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
