INVESTIGATION

SUMMARY

OF FITNESS-FOR-DUTY CONCERNS AT PRAIRIE ISLAND-(OFFICE OF INVESTIGATIONS (01) CASE NO. 3-91-001)

This refers to the review conducted by NRC representatives of this. office between October 24', 1990 and October 21, 1992. The inspection and investigation involved activities related to your Prairie Island' facility.

It included activities of your staff and the activities of some of your security contractors.

The final results of this review were discussed with Mr. Kuhn and other members of your staff by telephone on October 21. 1992.

Areas examined during this review are inntified in the enclosed summary.

Within those areas, the review consisted of selective examinations of-procedures, specific records and interviews with personnel.

Based on the results of this review, two apparent violations were identified and are being considered for escalated enforcement action-in accordance with the " General Statement of Policy and Procedure :for NRC Enforcement Actions" (Enforcement Policy), 10 CFR Part 2, Appendix C.

These apparent violations de'al with the implementation-of your security _ and Fitness-For-Duty (FFD) programs.

Accordingly, no Notice of Violation is presently being issued for these findings.

Please be advised-that the number and characterization of-apparent violations described in the enclosed document may change as'a result-of further NRC review.

We will contact you within ten days of the date of this letter to schedule an enforcement conference.

The purposes of this conference will be to. discuss the apparent violations, their causes and safety significance; to. provide you the opportunity to point out any errors in the enclosed document;..to provide an opportunity for you to present your proposed corrective actions; and to discuss any other information that will-help us determine the appropriate enforcement action;in accordance with the Enforcement Policy.

Specifically, we are interested in.your evaluation of whether the two apparent violations fwere willful on the part of the-involved Northern States.Pcwer (NSP):and contractor employees.

You will be advised by separate correspondence of the-results of our deliberations on this matter. No response regarding the.
