Dear Mr. Thornton:

In a March 5,1985, letter you had requested that we review the inquiry answers f

provided to you by ASME in response to questions raised during our inspection of your facility.

The answers were reviewed and we agreed that the answers appeared to conflict.

As a result we contacted Mr. Kevin Ennis, Boiler and Pressure Vessel Ccamittee Assistant Secretary, and discussed the answers provided. M r.

Ennis stated that the " Documentation" referred to in the last line of the reply to Interpretation III-80-99 was not intended to =ean a statement on the CMTR, but could consist of the Supplier's audit report docu:enting the review and approval of the Manufacturer's program.

Mr. Ennis further stated that NCA-3857.6 had been revised in the Winter 1983 I

Addenda to further clarify the CMTR data requirements when the Manufacturer does not possess a Quality System Certificate.

r Based on the discussions with Mr. Ennis and the change to NCA-3867.6 clarifying the Code requirements, it is our opinion that the Code does not require the CMTR to include a statement that the material was produced under a program which meets the require =ents of NCA-3800. However, with the date of the program stated on the CMTR and the Supplier's audit of the Manufacturer's program, docueentation that the program r.eets the requirements of NCA-3800 does exist, as long as the Supplier has performed an adequate audit.
