CHAIRMAN PALLADINO:

Good morning, ladies and 3

gentlemen.

This is an affirmation / discussion session.

We 4

had one item on the agenda, Severe Accident Policy Statement, 5

and I will give a status report on that and then we propose to 6

add another item that we will take up in just a moment.

7 It is my understanding that with regard to 8

Severe Accident Policy Statement, we are split on a two-two 9

basis on deletion of a portion of it and we have not had time 10 to resolve that.

11 I also understand that Commissioner Asselstine 12 has indicated that he is going to have extensive comments 13 which will take him about a week to prepare and we may want to 14 react to that.

15 COM'MISSIONER ASSELSTINE:

That is right, yes.

i 16 CHAIRMAN PALLADINO:

It may be that if there 17 are some good suggestions, we may even consider them.

So 1 10 don't believe we are ready to handle the severe accident 19 policy statement today.

20 COMMISSIONER BERNTHAL:

I agree but I think I 21 was the one that was urging that we get this thing out of here 22 and I am sorry to see that we can't apparently get it out of 23 here today, but I would like to make sure that we all 24 definitively now try to finish that thing by next week.

All 1 25 can do is to plead with you.

I think we have we have 2

the opportunity to resolve the differences among the four of

4 COMMISSIONER BERNTHAL:

I don't think that will 5

take long but if Jim ccn get his comments in by next week, 6

that would be helpful.

7 COMMISSIONER ZECH:

I agree we ought to get it 8

out as quickly as possible.

9 CHAIRMAN PALLADINO:

But I do think that we 10 ought to see those comments before we vote.

11 COMMISSIONER ASSELSTINE:

I think that would be 12 a good idea but those have to of necessity be somewhat 13 tentative until you guys decide what the policy statement is 14 going to say.

15 CHAIRMAN PALLADINO:

We are going to try to 16 work on that.

17 COMMISSIONER BERNTHAL:

That could be settled, 18 I think, by the end of the day.

19 COMMISSIONER ASSELSTINE:

Good.

21 and I think we should make every effort to do that by the end 22 of the day.

SECY-85-152 that has to do with attorney fees for public 2

interest groups.

It will take a short notice vote in order to 3

address that matter today.

SECY-85-152.

The title of it is " Disposition of an 10 Application for Award of Attorney Fees under Equal Access to 11 Justice Act by the Business and professional people for the 12 public Interest, Northern Indiana public Service Company, 18 regarding Bailly "1,"

docket number 50-367.

14 In this paper the Commission is being asked to 15 respond to a request from the Business and professional people 16 for attornwy's fees for its participation in the Bailly 17 license proceeding.

18 All Commissioners have approved an order which 19 was attached to our memorandum of May 21st which denies that 20 request based upon an opinion by the Comptroller General of 21 the United States that the Appropriations Act for Fiscal Year 22 1982 and subsequent years prohibits NRC funding of i

23 intervenors.

24 Would you please affirm your votes?
