THE UNIVERSITY OF TEXAS DOCKET NO. 50-602 CONSTRUCTION PERMIT Construction Permit No. CPRR-123 1.
The Nuclear Regulatory Commission (the Commission) has found that:
A.
The application for construction permit, as supplemented complies with the requirements of the Atomic Energy Act of 1954, as amended (the Act), and the rules and regulations of the Commission. There is reasonable assurance that the activities authorized by the permit will be conducted in compliance with the rules and regulations of the Commission, and all required notifications to other agencies or bodies have been duly made; B.
The facility is a utilization facility as defined in the Commission's regulations contained in 10 CFR Part 50, " Domestic Licensing of Production and Utilization Facilities";
C.
The facility will be used in the conduct of research and development activities of the type specified in Section 31 of the Act; D.
The University of Texas (the applicant) is technically and financially qualified to engage in the proposed activities in accordance with the Commission's regulations; E.
The applicant has submitted sufficient technical information concerning the facility to provide reasonable assurance that the facility can be constructed at the proposed location without undue risk to the health and safety of the public; F.
The applicant is a nonprofit educational institution and will use the facility far the conduct of educational activities and is therefore exempt from the financial protection requirements of Section 170.a of the Act; G.
The issuance of a permit for the construction of the facility will not be inimical to the common defense and security or to the health and safety of the public; and H.
After weighing the environmental aspects involved, the issuance of this construction permit is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

Pursuant to Section 104 of the Act, and 10 CFR Part 50, " Domestic Licensing of Production and Utilization Facilities," the Commission hereby issues Construction Pemit No. CPRR-123 to The University of Texas located in Austin, Texas, to construct the TPIGA research reactor (herein the facility) as described in the application dated November 9, 1984.

This permit shall be deemed to contain and be subject to the conditions specified in Sections 50.54 and 50.55, of said regulations; is subject to all applicable provisions of the Act, and rules, regulations, and orders of the Commission now or hereafter in effect; and is subject to the conditions specified or incorporated below:
A.
The earliest completion date of the facility is June 30, 1987.
The latest completion date of the facility is December 31, 1988.
B.
The facility shall be constructed and located on the site, as described in the application, at the Balcones Research Center in Austin, Texas.

This permit is subject to the limitation that a license authorizing operation of the facility will not be issued by the Comission absent finding that (a) construction of the facility is completed in accordance with the tems and conditions of this pemit, (b) the Commission finds that the facility authorized has been constructed and will operate in confomity with the application and the provisions of the Act and of the rules and regulations of the Commission, and (c) there is reasonable assurance that the health and safety of the public will not be endangered by operation of the facility in accordance with the procedures approved by the Commission in connection with the issuance of said license.

This permit is effective as of its date of issuance and shall expire on the latest completion date indicated in paragraph 3.A. above.
