Counsel, International Nutronics, Inc. on March 30, 1984 i' At Jim Lieberman's suggestion, I celled Gregory Parker to discuss the hearing request received from International Nutronics (INI) on February 22, 1984. fir. Parker infomed me that the primary reason for requesting a hearing was the timetable set out in the January 30th order. Given INI's financial situation, the timetable simply could not be met. I asked him whether i INI disputed NRC's characterization of the facts leading up to the January order. Mr. Parker thought there might be some dispute, which Bruce Thomas, i the Dover plant manger, could identify. Mr. Parker thought that any such factual disputes would be minor in nature. I asked Mr. Parker if he had seen the revised schedule submitted by Bruce Thomas during the meeting with NRC at the site on March 22, 1984. Mr. Parker stated he had not seen that particular schedule, but.it was his impression that those dates were consistent with the dates in INI's February 28, 1984 submittal, which he had seen. Hr. Parker also informed me that it appeared from all indications that INI's insurance carrier would reject their claim for coverage of the 1982 spill. I asked whether INI was leaking to the insurance policy as the source of clean-up funds. Mr. Parker stated that if the carrier paid "right away," that money would be the source of clean-up funds. If not, INI would have to provide clean-up funds from other sources. Mr. Parker anticipates going into litigation with the insurance carrier, and asked me what role NRC would take in that proceeding. I replied that NRC would need to detemine whether it agreed with INI's interpretation of the insurance policy, and only then would NRC be in a position to decide whether to support INI, likely in the _ form of an amicus brief. Throughout the conversation, Mr. Parker emphasized his willingness to negotiate with the NRC and his reluctance to go to hearing on this matter. I told Mr. Parker that his hearing request had been referred to the Commission, but we would certainly continue to negotiate with-INi. 4 I also asked Mr. Parker several questions related to the financial data he ^ submitted. Mr. Parker stated that an accurate decontamination cost estimate had not_been obtained. Early estimates placed the clean-up at $60-75,000, but it was clear that sum would now be exceeded. The inability to enter the cell area had prevented INI from obtaining a decontamination cost estimate. Total decontamination costs would depend on the condition of the site. I asked I Mr. Parker why $100,000 of clean-up costs had been charged to INI's 1983 fiscal year. Mr. Parker said the accountants had done that for reasons unknown to him. Dear Mr. Parker:
The NRC staff has considered the information you provided in your letter of April 11, 1984 concerning the decontamin6 tion schedule for the Inter-national Nutronics, Inc. (INI) Dover, New Jersey facility. The staff is prepared tc, treat the milestone dates contained in INI's March 21, 1984 submittal as target dates, subject to the conditions stated below. In return, INI would commit to October 19, 1984 as the final completion date for the entire decontamination of the Dover facility and use its best 3 efforts to meet the dates in its March 21, 1984 submittal. INI would also withdraw its request for a hearing on the January 30, 1984 order. As a demonstration of good faith that this matter will be promptly resolved to our mutual satisfaction, the staff will not take action under section 232 of the Atomic Energy Act et this time. The coriditions under which the staff will accept the decontamination mile- ~ stones as target dates are as follows. The Director of the Office of i Inspection and Enforcement would modify the January 30, 1984 order to l require INI to remove all waste which is currently packaged onsite at the j Dover facility as soon as practicable, but by no later than June 15, 1984. l The January 30th order would also be modified to require INI to submit a l monthly status report under~ oath to the Regional Administrator of NRC-- Region I. The report must be submitted on the 15th of every month, commencing on May 15, 1984, with the first report to cover the period April 1 through May 15, 1984. i i I have prepared the enclosed order setting forth the proposal outlined above. i l If the proposal is acceptabid to INI, please have INI's president indicate j his agreement to this settlement by signing this letter in the space designated below, and returning the signed letter to me. l BY EXPRESS Mall. 3Q ., c c,, A gw-rh
