PROPOSED IMPOSITION OF CIVIL PEllALTY - $62,500 This is to inform the Commission that a Notice of Viointion and Proposed Imposition of Civil Penalty in the amount of.$62,500 will be issued on or about December 28, 1992 to the Northeast Nuclear Energy company.
This action in based on two viointions involving the operation and testing of the unit's auxiliary building filter system and supplomontary leak collection system.
Specifically, it was determined that the systemn have betan operated <.inco plant startup in configurations that would not onnure that accident condition radiological rolonces were properly processed and it was also identified that periodic testing of the systems was inadequate to detect the problems.
Together the two violationc havo boon clasalfjed as a Soverity Level III problem.
The bwo civil penalty in this case han boon escalated 25 percent to $62,500 based on 100 porcent oscalation for prior opportunities to identify the problem, 50 porcont mitigation for licensco identification, and-25 parcont mitigation for corrective actions.
It should be noted that the licenson has not boon specifically informed of the enforcement action.
The schedule of issuance and notification is:

The licensco has thirty days from the date of thn Notico in which to respond.
Following NRC ovaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
