Dear Mr. Chilk:
This letter memorializes the conversation I had yesterday with William L.
Clements, in which Mr. Clements extended the time for the NRC Staff to respcnd to Commonwealth of Pennsylvania's Motion to Disqualify the Law Finn of Shaw, Pittman, Potts & Trowbridge, under the same tenns that an extension of time to respond to that motion was granted to Charles Husted. See, Letter to S. J. Chilk, from D. B. Bauser, dated June 10, 1985, enclosed.
Pursuant to Mr. Clement's request, I am sending a copy of this letter to members of the service list for Docket No. 50-289-CH.

Dear Mr. Chilk This letter memorializes the discussion that I had on the phone with you today with respect' to Mr. Rusted's request for the deferral of the time within which to answer the motion for disqualification 4f counsel filed by the Consonwealth of l
on May 28, 1985, the commonwealth of Pennsylvania filed a motion to disqual(fy the law firm of Shaw, Pittman, Potts &
'l Trowbridge from representing Mr. Charles Busted in the proceed-ing that Mr. Husted has requested concerning his integrity.
On June 4, 1985, Mr. Husted filed a motion to refer consideration of the Commonweal h's motion to the administrative law judge who will be appoi(nted to hear the Husted hearing.
The Commis-sion has not yet ruled on Mr. Eusted's June 4 motion.
4 In order to avoid foregoing his opportunity to respond to the merits of the Cocnonwealth motion, I called your office today to seek, on.Mr. Eusted's behalf, an extension of time 4
J within which to arswer the Commonwealth's motion.
Specifica l-ly, in the event Kr. Eusted's June 4 motion is denied, Mr.
Husted has request.ed a reasonable period of time after the Com-mission's order to respond to the Commonwealth motion.
As specified in the June 4 motion, if Mr. Rusted's motion is granted, it is ant'icip&ted that the administrative law judge will establish an appropriate schedule for responding i
