ORDER T0 f%CIFY LICENSE Afl0 TERMIi: ATE SHOU CAUSE ORDER DATED DECEMBER 8,1980 By EN-80-53, dated December 8,1980, the Commission was informed that IE had issued to Applied Health Physics, Incorporated an Order to Modify License (Effectively Immediately) and Order to Show Cause Why Such Modification Should I o: Se Made Permanent. This action was based en the licensee's failure to transfer all waste byproduct material to an authorized land burial facility as required by an order issued July 2,1930. After evaluation of the licensee's veritten response (dated January 27, 1981) to the December 8, 1930 Order, the Staff determined that the licensee's proposed actions were such that future activities invciving licensed material could be condue:ed in compliance with the Co mission's requirements. This is to inform the Commission that IE has issued to the licensee today an Order to Modify License No. 37-14600-01 to incorporate as requirements the licensee's statements in its letter dated January 27, ifSi an: to terr.inate the Order to I ow Cause datec Decemcer 8,1980. A news release has been prepared and viill be issued about the -ime the licensee receives the Cr:er. The licensee and tne Commonwealth of.:annsylvania are being informed by ts'epq:ne.
Un:er the terms of the Order, any person who has an interest affected by the ii:ense modification may request a hearing within 25 days of the date of the Order.
