20036 Gentlemen:
This letter responds to Lawrence Coe Lanpher's March 22, 1985 request for clarification of safeguards information requirements pertaining to Shoreham security matters.
The standards for identifying and protecting safeguards material are contained in section 147 of the Atomic Energy Act, 42 U.S.C. 6 2167, and in 10 CFR 9 73.21, with further guidance in NUREG-0794, PROTECTION OF UNCLASSIFIED SAFEGUARDS INFORMATION (1981).
Because information once released is difficult to retrieve, the Consnission i
urges the parties to confer, where appropriate, on which information is to be l
afforded safeguards treatment, and to adopt the conservative rule urged by
(
staff at the February 28, 1985 Conference of Counsel before the Low Power l
Board, i.e., "when in doubt, protect." The NRC staff will periodically review the information so protected to detennine whether such protection is justified.
