[NCl0SURE 1 NOTICE OF VIOLATION Georgia Institute of Technology Docket No.: 50-160 Neely Nuclear Research Center License No.: R-97 During an NRC inspection conducted on November 9-10, 1992, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C, the violation is listed below:

Section 3.2 of the licensee's Emergency Preparedness Plan specified that the State of Georgia and the Atlanta /Fulton County-Emergency Management Agency (EMA) will be notified for all incidents classified in accordance with the Plan as Notification of Unusual Event (NOVE) through General Emergency.

Section 6.4.b(8) of the licensee's Technical Specifications stated that written procedures shall be provided and utilized for a site emergency plan.

The procedure intended by the licensee to implement the requirements of Section 3.2 of the Emergency Preparedness Plan was Emergency Procedure 6100, " Emergency Notification" (Revision 03, approved September 26, 1991).

Contrary to the above, Emergency Procedure 6100_did not require notification of the State of Georgia for'all incidents classified as NOVE, and did not specify notification of the Atlanta /Fulton County EMA for any incidents classified as NOVE.through General Emergency.

This is a Severity Level V violation (Supplement VIII).

Pursuant to the provisions of 10 CFR 2.201, Georgia Institute of Technology is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission. ATTN: Document Control Desk,. Washington, D.C. 20555 with a copy to the Regional Administrator, Region II, within 30 days of the date of the letter transmitting this Notice of Violation (Notice), This reply should be clearly marked as a-" Reply to a Notice of Violation" and should. include for each. violation: .(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have '

been taken and the results achieved, (3) the corrective steps that will--
