Dear Mr. Price:

Attached are three (3) copies each of Endorsements No. 41, No. 42 and No. 43 to NELIA Insurance Policy No. NF-ll7 Endorsement No. 41 (effective January 1,1969) lists the subscribing incurance campanies and their proportional liability.

Endorsement No. 42 (effective January 1,1969) sets the advance premium for calendar year 1968 at $163,000; the standard premium at $163,400; and the reserve premium at $121,184.

Endorsement No. 43 (effective November 30,1968) amends the policy to conply with the new AEC regulations governing extraordinary nuclear occurrences.

1. The word "companics" wherever used in the policy means the sub-scribing companies listed below.
2. The policy shall be binding on such compe.nics only.
3. Each such company shall be liable only for its below-designated proportion of any obligation nssumed or c:cponse incurred under the policy because of such bodily injury or property dr.macc.

' 4. The effective period of this endoraement is from the beginning of January 1, 1969 ; to the close of December 31, 1969  ; or to the time of the termination or cancelation of the policy, if sooner. ,.

Nuclear Energy Liability Insurance Association ogree os follows: l l

1. With respect to any extrcordinary nuclear occ'urrence to which the policy applies os proof of financial protection and which

. (c) Arises out of or results from or occurs in the course of the construction, possession, .j or operation of the facility, or (b) Arises out of or results from or occurs in the course of the trcnsportation of nuclear material. to or from the facility, .

the insureds and the componies og ree to woive (1) any issue or defense os to the conduct of the claimant or the fcult of the insured:,

including, but not limited to:

(i) negligence, (ii) contributory negligenco,  ;

(iii) assumption of risk, and (iv) unforeseeable intervening causes, whether involving the conduct of a third person, or on act of God, (2) any issus or defense os to charitable or governmental immunity, and (3) ony issue or defense based on any statute of limitations if suit is instituted within three years from the dote on which the claimont first knew, or reasonably could have known, of his bodily injury or property damose and the cause thereof, but in no event more then ten years offer the date of the nuclear incident.

The waiver of any such issue or defense shcIl be effective regardless of whether such issue or defense may otherwise be deemed jurisdictional or reloting to on element in the cause of action.

2. The waivers set forth in paragraph 1. above do not opply to i (a) Bodily injury or property damage which is intentionally sustained by the claiment l or which results from o nuclear incident intentionally and wrongfully caused by the ciciment; (b) Bodily injury sustained byany claimant who is employed at the site of and in connection with the activity where the extmordincry nuclear occurrence takes place if benefits therefor are either payable or required to be provided under any workmen's com-pensation or occupational discose law; (over) rv ~

"Extrcordincry nuclear occurrence" means on event which the Atomic Energy Commission hcs da-termined to be on extraordinary nuclect occurrence es dafined in the Atomic Energy Act of 1954, cs amended.

" Financial protection" and "nuclect incident" have the mecnings given them in the Atomic Energy Act of 1954, os amended.

"Claiment"means the person or organizction octually susicining the bodily injury or property demcge and clso includes his assignees, legal representctives cnd other persons or organicctions entitled to bring on cetion for demoges on occount of such injury or demcse.
