In addition-to the aforementioned steps',=the C.:Helleman Brewing Company has designated Mr. Michael S. Biedron as the Corporate Radiation. Safety Officer to coordinate compliance with Nuclear Regulatory Commission regulations.
Appropriate. training vill be received by this individual'in the near future.
Finally, all plants have been instructed to diligently-perform maintenance checks on warning lights for devices containing radioactive sources and' ensure-that radioactive warning placards.are clearly visible'.

Dear Sir or Madam:
RE: REPLY TO A NOTICE OF VIOLATION (INSPECTION REPORT 999-90003/92035)
In response to your letter of October 7, 1992 and to document the items discussed in our telephone conference on September 30, 1992, the G. Helleman Brewing Company would like to state the following.
Violation A -- 10 CFR 31.5 (c) (8):
- 1) The Gamma 101 Case Inspector with the source installed was accidentally thrown into a dumpster by temporary employees hired to clean out storage areas in the old brewhouse. 7ne disposal was not intentional.
- 2) An attempt was made by Hellenan to retrieve the source from the landfill where it was deposited. Chemical Vaste Management, a firm licensed to work with radioactive material, was hired by Helleman to perform this task.
The search was unsuccessful and no abnormal radiation could be detected.
- 3) Helleman has instructed all employees, who work with the devices containing radioactive sources, that in no circumste-ces should a device be moved off line or into storage with the source in pln e.
The source must be removed by licenced personnel and can only be transferred or disposed of to persons holding a specific license.
In addition, a copy of Federal Regulations 10 CFR Part 31 has been sent to all facilities.
- 4) As of September 11, 1992 full compliance has been achieved.
Violation B -- 10 CFR 31.5 fc) (3)
- 1) The Gamma 101 Case Inspector was moved off line with the source in j
place and put into storage by Heileman personnel because it was intended to be reinstalled at the same facility in the future.
- 2) All employees who work with the devices containing radioactive sources have been instructed not to move cny device off line or into storage with the source in place. Copies of CFR 10 Part 31 have been sent to all facilities.
