l By Northeast Utilities letter, dated September 12, 1984 we received your l application and affidavit, dated July 31, 1984 and September 26, 1984, l respectively, transmitting WCAP-10587 the proprietary version of " Technical l Bases for Eliminating Large Primary Loop Pipe Rupture as a Structural Design Basis for Millstone Unit 3," and the non-proprietary version, WCAP-10586.

You requested that WCAP-10587 be withheld from public disclosure pursuant to 10 CFR 2.790.

Discussions among Westinghouse and NRC technical / legal staffs regarding the release of information considered by Westinghouse to be proprietary have resulted in Westinghouse agreeing to permit the NRC staff to release infor-i mation concerning mechanistic fracture mechanics analyses of RCS primary loop I

piping and large Class 1 piping attached to the RCS. The information which l Westinghouse agreed to release as stated in a letter to Darrell G. Eisenhut, I dated November 15, 1984 is as follows:

1. Plant parameters (operating temperatures, operating pressures, l pipe dimensions)
2. Margin numbers (e.g., a factor of _10 on a specific criteria)
3. Specific plant moments and forces
4. Reference to the analytical methods used (i.e., limit load)
5. Leak rates l 6. Reference crack size The information will be released in the staff's Safety Evaluation Report or in a Supplement to that report. Other than the items indicated above the report is considered to be proprietary.

a o Mr. R. A. Wiesemann You stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

1. Release of information developed by Westinghouse gives the competitor an advantage. The use of infomation developed by Westinghouse gives Westinghouse a competitive advantage over its competitors, therefore, it is withheld from disclosure to protect the Westinghouse competitive position.
2. The information sought to be withheld from public disclosure is owned and held in confidence by Westinghouse. It was transmitted to and received by NRC in confidence. The information is not available in public sources and release of this information to the public is likely to cause substantial harm to the competitive position of Westinghouse.

We have reviewed your application and the material based on the requireme.nts and criteria of 10 CFR 2.790, and on the basis of your statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information.

We have determined that WCAP-10587, " Technical Bases for Eliminating Large Primary Loop Pipe Rupture as a Structural Design Basis for Millstone Unit 3,"

should be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

We therefore approve your request for withholding pursuant to 10 C.F.R. 2.790 and are withholding WCAP-10587 from public inspection as proprietary, except as noted in paragraph 2 of page 1.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the t

l need arises, we may send copies of this information to our consultants working in this area. We will, of course, insure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this infomation from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, such as if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC needs additional infomation from you or makes a detemination adverse to the above, you will be notified in advance of any public disclosure.
