Dear Mr. Austin:

I am in receipt of your December 11, 1992, letter to Mr. John Wolff of Chevron Corporation concerning the contaminated soil areas at the Nuclear Lake site in Pawling, New York.

I have reviewed this letter and the November 1992 document entitled Nork Plan for the Soil Remediation of the National Park Service Property Located near Pawling, New York, for the Chevron USA, Incorporated.

In your letter this Work Plan was approved with some conditions.

On page one of the Work Plan it is stated " soil contamination levels will comply with the U.S. Nuclear Regulatory Commission (USNRC) agreed upon limits of 25 pCi/g for plutonium and 15 pC1/g for Cs-137."

On April 22, 1991, Mr. Bangart of the USNRC sent Ms. Norris of Chevron Corporation a letter that stated appropriate cleanup levels for this property as 25 pCi/g for plutonium and 7.5 pCi/g Cs-137.

The purpose of this letter is to request an explanation for approving a Work Plan with cleanup levels for Cs-137 double that considered appropriate the previous year.

Please let me know what is the appropriate cleanup level for Cs-137 and why the USNRC has revised its position, if it has done so.
