Gentlemen:

This is in recard to your request for approval of a route to be used for transport of spent reactor fuel as contained in your letter of December 5, 1979

Subject:

Advanced Transportation Route Approval.  !

We have detemined that the " Primary" route submitted with your December 5, i 1979 letter passes through heavily populated areas and thus does not meet  !

the requirements of 10 CFR Part 73.37(a)(3). Accordingly, in view of the '

l existence of an acceptable alternative route, the use of this route is  ;

disapproved. '

The " Alternate" route also subnitted with your December 5,1979 letter is judged to meet the reaulatory requirenents in accordance with 10 CFR Part 73.37 and accordingly is approved. ~

Picase note that assuring highway safety is the responsibility of the licensee and carrier and an approval is not intended to provide relief in this renard. Furthermore, the approval does not cuarantee that there will be no local or state legislation applicable to the route that '

restricts or prohibits the movenent of radioactive natorial.

Durinq the winter months vhan inclerent weather with accompanyinq hazardous road conditions can occur with short notice, the appropriate state police should be contacted with regard to road cenefitions lmfore a shipnent CoFYTnces.

The initial arrangements with law enforcement agencies alonq the route, as required by 10 CFR Part 73.37(a)(2), have been conpleted by the NRC staff. Data relatinq to these arrangements and a copy of the approved i route are enclosed. This information is to be incorporated into your shipment plan and provided to your carrier alonq with instructions r UfMTiy k^b L 1.bU.

. r Since the attachment to your letter of December 5,1979 contains information of a type specified in 10 CFR Part 2.790(d), it is deemed to be connercial or financial infomation within the meaning of 10 CFR Part 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR Part 9.12. For the sano reason, the enclosure to this letter is being withheld.
