Purpose:

Under the Urar,ium tiill Tailings Radiation Control Act of 1978 (UMTRCA),

ownership of sites used for permanent tailings disposal is required to be transferred to the Federal Government.

Anaconda has proposed to Bispose of tailings in underground mined out pits at the Corpus Christi

2 mill site. Anaconda states the tailinos will be essentially dry and the mines are at least sixty feet deep.

Anaconda has requested to be exempt fror the U"TRCt. requirement for transfer of ownership based upon the claim that this transfer is not necessary to assure tailincs impouncaent stability and a need for continued monitoring. The State of Texas has requested I;P. assistance in evaluat'ing the proposed project anc reking a detemination on the necessity of Governmnt ownership of the sitc.

Under U!iTRCA, only MRC can r. uke a determination that the land ownership j

requirements of the Act can be dispensed with.

i The purpose of the meeting was to discuss the scope of !;RC revie.: and associated schedules, and to arrive at a mutually agreeable approach for j

involving Texas in the NRC evaluation and determination.

URC will consult with Texas in nahing its determination on land ownership.. Texas will provide coments and make its recomendation on the determination to NRC after consultation I

on the technical issues between persons at URC and the State who will be reviewing the case.

Texas will identify tiithin about a week the geologist / hydrologist in the State who will be reviewing the case to work with R. Hilliams and G.1.'u (HRC ProjectM: nager).
