Dear Mr. Nietubicz:

This is to acknowledge receipt of your letter sent to our Region III office in which you asked that legal action be instituted to rectify the alleged problem with flood-threatened evacuation routes for certain areas near the Detroit Edison Company's Fermi Unit 2 facility. Your request will be handled pursuant to 10 CFR 2.206 of the Commission's regulations. Accordingly, appropriate action will be taken within a reasonable time.

As you may know, the Nuclear Regulatory Commission is primarily responsible for assessing the adequacy of onsite emergency plans developed by nuclear power plant licensees and has the final licensing authority. The Federal Emergency Management Agency (FEMA), by Presidential directive, has been assigned the responsibility for assessing the adequacy of offsite emergency planning around nuclear power plants. Accordingly, I am forwarding a copy of your correspondence to FEMA headquarters for evaluation. Upon completion of FEMA's evaluation, I will make a final determination based on FEMA's report and other relevant information.

Based on our preliminary review of your petition, I do not believe that immediate enforcement action is necessary to suspend or otherwise limit operation of Fermi Unit 2.

Enclosed for your information is a copy of a notice that will be sent to the Office of the Federal Register for publication.
