Femreite, Plant Manager SUBJECT : NRC INSPECTION REPORT NO. 70-1257/92-08 This refers to the special onsite team inspection conducted on October 15-17 and 29, 1992, by the NRC of activities authorized by NRC License No. SNM-1227 and to the discussion of our findings with you and other members of your staff at the conclusion of the inspection.

Areas examined during this inspection are described in the enclosed inspection report. Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observations by the inspectors.

Based on the results of this inspection, certain of your activities appeared to be in violation of NRC requirements, as specified in the enclosed Notice of.

Violation (Notice). The first apparent violation involves the failure of the Criticality Safety Analyses (CEAs) to evaluate all credible conditions. The second violation concerns the f ailure to evaluate the consequences of a process upset and determine if the condition was reportable.

I am concerned with the types 01 problems and apparent violations that continue to be identified at youc facility. Similar problems regarding the adequacy of CSAs and the failure to evaluate and report unusual events to management personnel in a timely manner were identified in NRC Inspection Report No. 70-1257/92-06. An adequate criticality safety program must-include several elements such as the analysis of potential process upsets that may.

affect criticality safety, timely evaluation of upsets when they occur, and timely involvement of management in the evaluation. Your actions to ensure that your program adequately emphasizes these elements will be closely monitored by my staff.

- Regarding Violation I, you are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. In your response, you should document the specific actions taken and any additional actions you plan.to prevent recurrence. After reviewing your response to this Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether future NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements. ..

Although 10 CFR 2.201 requires you to submit to this office a written statement of explanation, no such response will be required for Violation II,-

-a repeat violation, because it has been corrected and your corrective actions were reviewed during this inspection.

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter and the enclosures will be placed in the NRC's Public Document Room.

The responses directed by this letter and the enclosed Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Redut tion Act of 1980 Pub. L. No.96-511.

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of this letter and the enclosures will be placed in the NRC's Public Document E Room.
