As a result of the inspection conducted on 11ovember 4, 1992, and in accordar.cc with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Arpendix C (Enforcement Polir y) (1992), the following violations were identifled:

10 CFR 31.5(a) issues a general license to local government ager.cies to acquire, receive, possess, use or transfer, in accordance with the provisions of paragraphs (b), (c) and (d),

byproduct material contained in certain measuring, gauging or _

controlling devices.

1. 10 CFR 31. 5 ( c) ( 3 ) requires, in part, that removal of a generally licensed device be performed by a person holding a specific license to perform such activity.

Contrary to the above, on September 11, 1992, a generally licensed device was removed from its installed position by persons not specifically licensed to perform '.his activity.

In addition, the device was in the " measure" <r open shutter position f rom this date until Sep'.cmber 29, 1992, while stored on the floor in a room with unrestricted access.

2. 10 CPR 31. 5 (c) ( 2 ) requires, in part, that any person who possesses material under the general license shall assure that the device is tested for leakage of radioactive material and proper operation of the on-off mechanism and indicator at _

intervals as are specified in the label. Three year intervals are specified.

Contrary to the above, from August 21, 1975 to September 28, 1992, the device was not tested for leakage or proper operation of the on-off mechanism.

These are Severity Level IV violations (Eupplement VI).

Pursuant to tt'e provisions of 10 CFR 2.201, Iancaster Area Se'/er Authority (LASA) is hereby required to submit to this of fice within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including:

(1) the correctivo steps which have been taken and the results achieved; (2) corrective steps which will be taken c avoid further violations; and (3) the date when full compliance wall be achieved.

Where good cause is shown consideration will be given to extending c

this response time.
