Dear Mr. Roy:

This letter follows the telephone conversation between you ard Roy Person, of my staff, on November 6, 1992, in which you were informed that the Nuclear Regulatory Commission is in the process of closing it's review, without approval, of two Scientific Ecolology Group (SEG) Incorporated topical n'eports (TRs): 1) " Topical Report on 10 CFR 61 Qualified Radioactive Waste Forms" (WM-20) and 2) " Cement Solidified Wastes to Meet the Stability Requirements of 10 CFR Part 61" (WM-46).

We are considering closing our review of WM-20 because SEG has not responded to the two enclosed requests for additional information which were issued on January 07, 1992 and April 02, 1992, respectively.

Please note that none of the reviewed waste formulations contained in WM-20 can be granted approval prior to our receipt of acceptable responses and/or test data as requested in the letter of April 2,1992.

With regard to TR WM-46, interim approval (for the period September 30, 1991, to September 30, 1992) was issued for six waste stream formulations (see the interim approved waste formulations listed belca).

These waste formulations were submitted as part of the WM-46 TR and interim approval for their use was granted based on testing performed in accordance with the original Branch Technical Position on Waste form for 10 CFR Part 61 (Revision 0,1983). 'This testing was performed prior to issuance of additional test critieria now r

contained in the new Appendix to the Technical Position.

Continued, approved use of the six waste streams, following expiration of the interim approval period, was contingent on SEC submitting and NRC finding acceptable, test results which meet the criteria in this new Appendix. However, the interim approval period has expired and SEG has not indicated any mitiative to l

provide the necess uy test data. Therefore, the NRC review offort for this TR l

1s being phased out. The interim approval for the following.vaste l

Diatomaceous Earth 3.

Filter Sludge L

4.

20% Sodium Sulphate 5.

5% Sodium Sulfate with 30% Mixed Solids 6.

20% Sodium Sulphate with 62% Mixed Solids e

Please take all actions necessary to assure that your above formulations will not be marketed as NRC approved waste media, D

respond within 60 days of the date of this letter with either a response to our previous questions or a schedule for providing your re;ponse along with a justification for the delay.

If you do not respond within 60 days with an adequate justification for continuing the review, NRC review of both topicals will be closed without approval.

We are prepared to complete our review of this TR (Docket No. VM-20), and would appreciate your attention to these outstanding issues.

In the event that the above-referenced fax transmission was not received, a second copy of RAI #2 is enclosed, Please advise us regarding your schedule for completing this action.

t On September 30, 19G1, the NRC lasued an Interin Technical Evaluation Report (ITER) regarding SE0's topical report, " Cement Solidified Wastes to Meet the Stability Requirements of 10 CFR Part 61" (Docket No. VM-46).

topical report including related information developed during the technical review was to have been submitted to this office by November 30, 1991. We have not yet received the revised TR.

In addition, the interia approval will expire on October 1, 1992.

Final approval of the TR is based on submission and approval of a final revised topical report which includen information on additional qualification testing on the interia approved waste streams, revised PCP documents, a design for filter encapsu!ation in grout, and other t

Information, as specified in the ITER cover letter (M. Tokar (NRC) to B. Roy (SEG) dated September J0, 1991).

We are interested in the progress of the additional qualification testing, and in the status of the TR as a whole.
