New Hampshire (PSNH) submitted (1) " Technical Basis for Eliminating Large

Primary Loop Pipe Rupture as the Structural Design Basis for Seabrook Station Units 1 and 2", WCAP-10567 and (2) information regarding flow measurement uncertainty, respectively and requested that they be withheld from public disclosure pursuant to 10 CFR 2.790.

PSNH also submitted your related affidavits and applications for withholding in which'you stated that.the submitted information should be considered exempt from mandatory public disclosure for-l -

the following reasons:

The information sought to be withheld is owned by and-has been held in confidence by Westinghouse and is not available to the public; the information is customarily held in confidence by Westinghouse; and public disclosure of the information would likely cause substantial harm to the competitive position of Westinghouse because your competitors.could utilize the l

information to assess and justify their designs without commensurate expense.

We have reviewed your applications and the material based on the requirements and criteria of 10 CFR 2.790 and, on the basis of your statements, have I

determined that the submitted information sought to be withheld contains trade L

secrets or proprietary commercial information.

Therefore, the versions of the submitted information marked as proprietary will be' withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

l Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.

If the-need arises, we may send copies of this information to our consultants working in ~ this area. We will, of course, ensure that the consultants have signed the l

appropriate agreements for handling proprietary information.
