SUBJECT:
NRC/ STATE OF NEW YORK / CON ED/PASNY MEETING ON SEISMIC MONITORING NEAR INDIAN POINT On December 12, 1979. Janice Moore (0 ELD, NRC), Bruce Berson (0 ELD, NRC),
Jerry Harbour (RES, NRC), Rutlage Bragee (hES, NRC), Sandra Carow (New York Energy Office), R. H. Fakundiny (New York State Geological Survey), T. X.
DeBoer (New York State Energy Office), Angel Martin (PASNY), Joyce Davis (Con Ed), and myself met to discuss the status of Con Ed's informal offer to donate their seismic network to Lamont. The State of New York views itself as having the legal mandate to continue seismic monitoring of the Ramapo Fault. The State finds that they should take possession of the con Ed net-work and they should have control over the operation of the network.
In sup-port of this finding, the State noted that they own the seismic equipment used in the Lamont network. The Con Ed and PASNY attorneys saw no reason not to donate the network to the State. Con Ed noted that they have continued to operate the network as they promised in an affidavit which was part of a Motion to Show Cause and, as stated in the affidavit, will continue to monitor until the NRC reaches a final decision.
The NRC. State, con Ed and PASNY attorneys began to draft a Stipulation of Settlenent Agreement which includes the following premises:
1.
The State and CCPE will withdraw their petitions for Commission review, 2.
Con Ed and PASNY, who jointly own the seismic network, will donate the deed to the stations to the State of New York, and 3.
The NRC will fund increased seismic monitoring of the Ramapo Fault and neighboring faults using these new stations.
All parties are seeking to sign the agreement on January 14, 1980.
- CCPE, another petitioner, will be contacted to take part in the agreement.

-Z-1973 OELD has no plans to use the material in the Staff memorandum from me to you on seismic monitoring near Indian Point (November 19, 1979). OELD forsees no future actions by NRR on this topic.
