TELECON - CONGRESSMAN MARKEY At about 4:40 p.m. on Friday, October 5, 1984, I received a telephone call from Congressman Mar. key.,
He indicated that he was calling with regard to the Diablo Canyon transcripts which we sent to him on a confidential basis (see attached letter).
His particular concern was the subject of the impact on emergency planning.
He began the conversation on the specifics with a statement that he,will maintain the confidentiality of these transcripts in accordance with the commitment he made to me.
He would like all the Commissioners to know this.
Nevertheless, he indicated, he is troubled by the nature of the deliberations that went on in the meeting and he believes the public would be best served if the Commission would agree to the release of the transcripts.
He said he saw no benefit in retaining confidentiality.
When I asked Mr. Markey wh,at, troubled him about the transcripts, he responded that his concerns include the fact that we did not go along with the proposal of OGC that had lower litigative risks; that we violated Section 189 of the Atomic Energy Act in that the issue is material to Diablo Canyon; and that the Commission improperly relied on extra record material (e.g.,
Tera report) in reaching its decision.
I agreed that OGC had said to take the path of least litigative risk but I told Mr. Markey that was not what our feeling was.
I told him that I thought his characterization of our deliberations was wrong and that I thought what we did was objective.
However, I did affirm that I would ask individual Commissioners to consider releasing the documents as he had requested.
I told him that I could not do it today but that I would get to it early next week.
