Dear Mr. Grimsley:

This is a non-commercial request under the Freedom of Information and Privacy acts.

As stated in section (4) (A) of the Freedom of Information Act, 5 U.S.C. 522, as amended in 1974 by public law 93-52, the information requested by Grand Rapids Magazine is

'primarily benefiting the general public,* so i request a waiver of any fees.

i request a complete and thorough search of all filing systems and locations for all records maintained by your agency pertaining to the enclosed document and the issues and events mentioned therein.

This request specifically includes, but is not limited to, numbered and lettered subfiles, memos, investigation reports, licensee event reports, copies of photographs, searc5 slips, abstracts, tapes or handwritten typed logs, transcriptions of telephone conversations and of interviews, and any other kinds of documents.

I wish to make it clear that I want all records in your office ' identifiable with' this -

request, even though reports on those records or copies of the records remain in another office, such as Region lll in Chicago. I do not want ' interim

  • documents only. I want all documents as they appear in all files, in all forms in all units of your agency.

If documents are denied in part, please specify the exemptions claimed for each page or passage. For documents withheld in their entirety, please state, in addition, the date of and the number of pages in each document. If any records responsive to this request are stamped or in any way identified as classified (or as ' safeguards information'), please treat this as a request that such records be declassified.

I request that excised material be ' blacked out' rather than ' whited out' or ' cut out' and that the remaining non exempt portions of documents be released as provided for under the Freedom of information Act. Please advise of any destruction of records and include the date of and authority for such destruction.

Please call rather than write if you have any questions concerning this request. I expect a response to this request within ten (10) working days, as provided for in the Freedom of information Act.

Gentlemen:

NRC Region !!! h65 received an allegation concerning the Fitness for Duty Program at the Palisades Nuclear Plant.

The enclosure to this letter describes the allegation received which requires resolution and a response.

We are concerned that the identified issue may represent inconsistent implementation of your Fitness for Duty Program.

We request that the Consumers Power Corrpany fully analyze the allegation and take all af.tions you deem appropriate to resolve the issue. We also request that the results of your review and dispesition be submitted to us within 30 days after receipt of this letter. We request that your response contain no personal privacy proprietary, or safeguards information so it can be released to the public and placed in the NRC Public Document Room.

If necessary. Such infomation shall be contained in a separate attachment which will be withheld from rublic disclosure.

The enclosure to this letter should be controlled and distribution limited to personnel with a "need-to-know" until your investigation of the allegation has been ccepleted and reviewed by NRC Pegior. Ill.

The enclosure to this letter is considered as bempt from Public Disclosure in accordance with Title 10 Cote of Federal Regulations, Part 2.790(a).

However, in accordance with 10 CFR 2.790 of the Corrission's regulations, a copy of this letter, ercluding the enclosure, will be placed in the NRC Public Document Room.

The responte directed by this letter is not sub,iect to the clearance procedure of the Office of Pana Act of 19F0, FL 96 51gement and Budget as required by the Paperwork Reduction l
