! The Commission, by a 5-0* vote, approved an order responding to a

' petition from Piping Specialists, Inc. (PSI) requesting Commission review of a Licensing Board Decision:(LBP-92-25) which l

revoked the byproduct material license held by PSI. The order denied the licensee's petition for review.

(Subsequently, on December 1, 1992,-the Assistant Secretary j signed the Order.)

• Section 201' of the Energy Reorganization Act, 42 U.S.C. S5841, provides that action.of the Commission shall be determined by a-

" majority vote of the members present." Chairman-Selin was not

~

present when.this item was affirmed. Accordingly, the formal vote of the Commission was 4-0 in-favor of the decision.

Chairman Selin, however, had previously indicated that_he would approve this paper and had he been present,he would have affirmed his prior. vote.
