Columbia, Missouri Docket No. 050-00186 Subiect PROPOSED IMPOSITION OF CIVIL PENALTY - $625 AND DEMAND FOR INFORMATION This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $625, as well as an accompanying Demand for Information, will be issued on or about December 2, 1992 to University of Missouri - Columbia.
These actions are based on an incident in two which shipping packages containing radioactive material produced in the research reactor were labeled with an incorrect isotopic activity and sent to the wrong recipient. The associated violations have been categorized as a Severity Level III problem. The civil penalty was mitigated for licensee identification and corrective action, but escalated for poor prior performance in the area of concern.
Because distribution of irradiated products to the wrong recipients was the subject of previous escalated enforcement action against this licensee (EA 91-113), the Demand for Information requires the licensco to submit information as to whether adherence to improved procedures to control the preparation and shipment of reactor produced materials should be required by the NRC license.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
