Dear Dr. Butler:

In response to a request made at a May 24, 1985 meeting between the NRC Staf f and Philadelphia Electric Company, this letter addresses compliance with the. Commission's Statement of Policy on Emergency Planning Standard 10 CFR 50.47(b)(12) as published in 50 Fed.

Reg. 20892 (May 21, 1985).

The Statement of Policy resulted from a decision of the United States Court of Appeals' for the District of Columbia Circuit in GUARD v. NRC, 753 F.2d ll44.(D.C. Cir. 1985).

With regard to offsite emergency planning, the matter of compliance with Commission planning Standard 50.47(b)(12) was not a contested matter before the Atomic Safety and Licensing Board.

The Commonwealth of Pennsylvania Disaster Operations Plan, Annex E, Appendix 13, Attachment J, contains a list of area hospitals capable of providing medical care for contaminated, injured individuals.

Additional listings are shown in the Montgomery (Appendix G), Chester (Appendix 2, Annex G), and Berks (Appendix G) Ccunty Radiological Emergency Response Plans and in the Lehigh and Bucks County Plans in Appendix 6.

Moreover, Philadelphia Electric Company commits to full compliance with the Commission's response to the GUARD remand.
