Determination of no decrease in Emergency Plaa effectiveness in accordance with 10 CFR 50.54(q)

Ladies and Gentlemen:

In accordance with 10 CFR 50.54(q), Davis-Besse hereby submits its justification for the elimination of the Utility Mutual Aid Agreement, which is currently contained in Appendix C to the Davis-Besse Emergency Plan. The elimination of this Agreement will not decrease the effectiveness of the aforementioned Plan.

The Devis-Besse Emergency Plan Revision 18, Appendix C, Sample Letters of Agreement, contains both the Mutual Assistance Agreement and the Institute of Nuclear Power Operations (INPO) assistance agreement. The Mutual Assistance Agreement is a regional agreement between utilities that own and operate nuclear power stations. Although useful when created, its importance has diminished as the INPO agreement has matured.

The INPO emergency assistance agreement between INPO and member utilities provides access not only to assistance from those utilities who are signatories of the Mutual Assistance Agreement, but from all INPO member utilities.

Therefore, the INPO agreement is of broader scope than the Mutual Assistance Agreement. Due to the redundant nature of these two agreements, the Mutual Assistance Agreement was allowed to expire May 1, 1996, and will not be renewed.
