Dear Mr. Cummings:
This is to confirm the conversation I had with you on February 18th and with John Sinclair on February 19,^ 1982.
It is my understanding that Robert Warnick, Region III Investigative Branch Chief, has confirmed our belief that there has been no formal referral to the Justice Department for prosecution.
Rather, I 6 E is continuing its investigation and still has several areas it is pursuing, including:
the qualifications of some inspectors; equipment (sizemic hangars, cable trays); the procedures for design document changes; and the systems turnover program.
It is also my understanding that I6E wishes to conduct additional interviews.
I greatly appreciate your obtaining this con-firmation so promptly.
Please advise this office immedi-ately of any change in status.

Thi's office has been advised that Region III of the Office of Inspections and Enforcement is still in the process of conducting an inspection at the Zimmer Nuclear Power Plant, Moscow, Ohio.
As you know, because of the concerns of the NRC, a criminal investigation might impair your civil enforcement efforts.
Consequently, we would appreciate your advising this office when you expect to complete your inspection and submit a final report.
