Decommissioning Funding Plan, Irrevocable Letter of Credit
Dear Dr. Weiss:
The Decommissioning Funding Plan detailed in Section 5 of the Fort St. Vrain (FSV).-
Proposed Decommissioning Plan includes a $125 million irrevocable Letter of Credit.

This irrevocable Letter of Credit provides assurance that any decommissioning costs not covered by an external trust fund would be suitably funded, as authorized by 10 CFR-50.75(e)(3)(iii).
Although the irrevocable Letter of Credit will not actually_ be signed until the-NRC -
approves the Proposed Decommissioning. Plan,. PSC : currently' hasi. a. _ Letter: of-Commitment from the Bank of New York to sign the irrevocable Letter of Credit when NRC approval is received.. This~ Letter.of Commitment expires on November 25,1992..
The following discussion addresses the implications of not receiving NRC approval of the Proposed Decommissioning Plan by November 25,"1992.
q ISC has contacted the Bank'of New York and has requested an extension of the Letter of Commitment,- for a period of time _ not to exceed;120 days. :The Bank'of New York <
. is currently cor,tacting the other participating banks, which is time consuming due to the '
approval processes at these other banks',.some of which are international. There is no assurance that an extension.:will;be. granted snor that the_ fees will remainLthe'same.
- However, PSC is reasonab_ly confident that such an extension can be obtained.: The fees associated vMth extending the Letter of Commitment are expected to be $78,993 per..

In addition, PSC will incur -legal fees of approximately $10,000 for the.
