Dear Sir,

i I am in receipt of correspondence dated June 24,1996, from Houston Lighting & Power i

Company directed to your attention penaining to a request for authorization to grant Department

- of labor personnel access to certain trial exhibits and documents alleged by HL&P to contain safeguards inforno en. I am concerned that HIJcP is once again attempting to delay the adjudication cf this matter. Given the previous authorization obtained in July of 1993 pertinent to Ods matter, it is difficult to believe that this is truly a necessary step. Instead, this appears 1

to be another effort by HL&P to lend credence to its flimsy assertion that the subject documents actually contain safeguards material. This suspicion is furthered by the fact that following the June 5 conversation with Judge Miller, I was advised by another HIJcP attorney that all that would be necessary to effect the transfer wor.id be to insure a safe repository and fingerprint those at the Department of labor who would have access to the material.

Regardless of the reasons, given the extraordinary and protracted delay in all aspects of l

this matter, I would respectfully request that you promptly authorize access to the subject documents or, alternatively, review the subject documents and, having reviewed them, advise i

l the Department of Labor that in fact the documents do not contain safeguards materials so that

. these steps are unnecessary.
