re-. e April 16,1985 INTERVENORS' RESPONSE TO APPLICANTS' MOTION TO COMPEL A RESPONSE TO APPLICANTS' FOURTH SET OF INTERROGATORIES AND REQUEST FOR PRODUCTION OF DOCUMENTS Intervenors have now responded to Applicants' Fourth Set of Interrogatories and Request for Production of Documents.
Intervenors made clear to Applicants' counsel on several occasions its intent to do so.
On 12 April 1985, Doug Teper explained to Jim Joiner that he had been unable to complete the responses in light of the overwhelming documents to review and that he would therefore file at the beginning of this week. On 15 April 1985, I confinned this with Mr. Joiner who had no objections but did reserve the right to file a motion to compel within ten days after receiving the Intervenors' response; Mr.
Joiner said he would notify the Board of this by letter; I said Intervenors would stipulate that Applicants have the right to file the Motion to Compel within ten days following the Intervenors' responses.
In view of the Intervenors' arrangements with the Applicants, we submit that the Motion to Compel was inappropriate.
In any case, Intervenors have now responded to the interrogatories and request for production, so the Motion to Compel is moot.
