In compliance with the provisions of the Federal Water Pollution Control Act and pursuant to the State Water Control Law and regulations adopted pursuant thereto, VEPCO & OLD DOMINION ELECTRIC COOPERATIVE

-is authorized to discharge from a facility located at Lake nna off State Route 700, Louisa County, Virginia 4

to receiving waters named Lake Anna and North Anna River, Section 3, York River Basin, Class III, Special Standards: None in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in this permit.

2.

Design and operation of facilities and/or treatment works and disposal of all wastes shall be in accordance with the application filed with the State Water Control Board and in conformity with the conceptual design, or the plans, specifications and/or other supporting data approved by the Board.

The facilities shall be operated in accordance with the conditions of the permit.

3.

The approval of the treatment works conceptual design or the plans and specifications does not relieve the permittee of the responsibility of designing and operating the facility in a reliable and consistent manner to meet the facility performance requirements in the permit.

If facility deficiencies, design and/or operational, are identified in the future which could affect the facility performance or reliability, it is the responsibility of the permittee to correct such deficiencies.

Debris collected on the intake trash racks shall not be returned to the waterway.

2.

There shall be no discharge of polychlorinated biphenyl transformer fluids to navigable waters that originate from this source in amounts equal to or greater than detected by EPA Test Methods specified in the Federal Register 40 CFR Part 136, Guidelines for Establishing Test Procedures for the Analysis for Pollutants.

3.

All limitations and monitoring requirements for liquid radioactive waste discharges shall be regulated by the Nuclear Regulatory Commission in accordance with regula-tions as set forth in 10 CFR part 20 and 10 CFR part 50.

4.

The permittee has requested alternative effluent limitations under Section 316(a).

VEPC0 will conduct a 316(a) study and will submit a demonstration report on the study. The Board approved 316(a) study plan was implemented on 1 January 1984 and shall be concluded within two years of implementation. Within 3 months of the completion of the 316(a) study, VEPC0 shall submit a. draft final report to the Board. During the 316(a) study, should serio~us adverse impacts develop as a result of the thermal discharge, the Board reserves the right to reopen and modify the permit as expressed in Part III.B.4 or as deemed necessary to assure adequate pro-tection of the biota in Lake Anna and the North Anna River.

5.

The permittee shall at all times provide minimum instantaneous release from the impoundment of at least 40 cfs.

6.

The findings of fact and conditions set forth' in the 401 CertiIicates issued by the Board on August 29, 1973, and the 21(b) certificate as amended on February 11, 1972, are incorporated herein by reference as limitations and shall continue in full force and effect.

These certificates may be revised in the future. Upon the completion of any amendments, the revised certificates shall be incorporated herein by reference as specified above.

7.

In the event final water quality standards revisions are approved, the permit shall be modified by the Board or upon the request of the applicant to reflect the require-ments of any such changed standards.

8.

The permittee shall prepare a report which summarizes the impingement and entrain-ment information collected from the initiation of commercial operation of Unit 1 through December 31,1983, inclusive. After the summary report has been reviewed by the Board, the permittee will be notified of the conclusions and whether or not the Board believes that the permittee should submit a plan to reduce the number of fish, eggs and larvae entrained or impinged. A modified impingement and entrain-ment study may also be required as a result of the review of the Summary Report and/or the remedial action, if any is deemed necessary.

9.

Temperature monitoring program shall be done on a schedule as listed below and -

identified in accordance with accompanying Charts #1 and #2, except for the period l

of time during which the 316(a) demonstration is being conducted.

Temperature measurements are to be taken during daylight hours from the surface to the bottom at meter intervals at Stations A through N on Chart #2.

10. The permittee shall provide notification 'to the Board prior to the use of chlorine or other biocide for any purpose other,than disinfection at the sewage treatment plants.
11. This permit may be modified or alternatively revoked and reissued to comply with any standard or limitation which results from the recommendations of the Disinfection Task Force.
12. Semiannual toxicity tests shall be conducted on outfall 011 using Daphnia palex and fathead minnow, Pimephales promelas.

The Daphnia test shall be a 48-hour static test and the fathead minnow test shall be a 96-hour static test, both conducted in such a manner and at sufficient dilutions for calculation of a valid LC50.

If a test results in an LC50 of less than 100%, then further toxicity testing may be required. Technical assistance in developing the pro-cedures for these tests shall be provided by the State Water Control Board staff and all procedures shall be approved by the staff.

13.. Annual toxicity tests shall be conducted on outfall 010 using Daphnia puler and the fathead minnow, Pimephales promeZas.

The Daphnia test shall be a 48-hour static test and the fathead minnow test shall be a 96-hour static test, both conducted in such a manner and at sufficient dilutions for calculation of a valid LC50.

2.

Test Procedures Test procedures for the analysis of pollutants shall conform to the applicable test procedures identified in 40 C.F.R. Part 136 unless otherwise specified in this permit.

3.

Recording of Results For each measurement or sample taken pursuant to the requirements of this permit, the permittee shall record the following information:

a.- The date, exact place and time of sampling or measurements; b.

The person (s) who performed the sampling gr measurements; The dates analyses were performed; c.

d.

The person (s) who performed each analysis; The analytical techniques or methods used; and e.

f.

The results of such analyses and measurements.

4.

Records Retention All records and information resulting from the monitoring activities required by this permit including all records of analyses performed and calibration and maintenance of instrumentation and recording from continuous monitoring instrumentation shall be retained for three (3) years. This period of retention shall be extended automatically during the course of any unresolved litigation regarding the regulated activity or regarding control standards applicable to the permittee, or as requested by the Board, 1

Additional Monitoring by Permittee

~ If the permittee monitors any pollutant at the location (s) designated herein more frequently than required by this permit, using approved l

analytical methods as specified above, the results of such monitoring shall be included in the calculation and reporting of the values required in the Discharge Monitoring Report (DMR). Such increased frequency shall also be indicated.

6.

Water Quality Monitoring The Board may require every owner to furnish such plans, specifications, or other pertinent information as may be necessary to determine the effect of the discharge on the water quality or such information as may be necesgary to accomplish the purposes of the State Water Control Law or Clean Water Act.

The permittee shall obtain and record such information on the receiving waters as requested by the Board. Such information shall be subject to inspection by authe-ized State and Federal representatives and shall be submitted with such frequency and in such detail as requested by the Board.

7.

Reporting Requirements a.

If, for any reason, the permittee does not comply with any maximum daily or average weekly discharg.e limitations or standards specified

in this permit, the permittee shall submit to the Board with the DMR at least the following information:

(1) A description of the discharge and"cause of noncompliance; (2) The period of noncompliance, including exact dates and times and/or the anticipated time when the discharge will return to compliance; and (3) Actions taken or to be taken to reduce, eliminate, and prevent l

recurrence of the noncomplying discharge.

l b.

In the case of any discharge subject to any applicable toxic pollutant i

effluent standard under Section 307(a) of the Act, the information required in paragraph (a) regarding a violation of such standard shall be provided immediately, that is as quickly as possible upon discovery.

If this information is provided orally, a written sub-mission covering these points shall be provided within five days i

l of the time the permittee becomes aware of the circumstances covered

(

by this paragraph.

c.

In the case of other discharges which could constitute a threat to human health, welfare, or the environment or are considered to be unusual or extraordinary

  • discharges pursuant to the Board's Regulatic n No. 4, the infomation required in paragraph (a) shall be provided immediately, that is as quickly as possible upon discovery.

If this information is provided orally, a written submission covering these points must be provided within five days of the time the permittee becomes aware of the circumstances covered by this paragraph.

  • Unusual or extraordinary discharges would include but not be limited to any discharge of waste resulting from (1) spillage of materials resulting directly or indirectly from the owner's processing opera-tions, (2) breakdown of processing or accessory equipment, (3) fail-ure of or taking out of service, sewage or industrial waste treatment facilities or auxiliary facilities, or (4) flooding or other acts of nature.

If the Regional Office cannot be reached, the Board maintains a 24-hour telephone service in Richmond, telephone number 804/257-0080 to which the report required in (b) and (c) above are to be made.

d.

Pollutants for which the permittee must report violtaions immediately pursuant to (b) and (c) are listed as such in this permit in Part I(A).

e.

The permittee shall submit to the State Water Control Board Regional Office, at the address listed below, by the 10th of each month an original of the National Pollutant Discharge Elimination System Dis-charge Monitoring Report of the facility's performance in accordance with Part I.A.

In addition, a monthly report covering the facility's general operational data may be required.

Before utilizing the services of any person or commercial laboratory as defined in Section 6.45 of the Board's Regulation 6 to perform any permit monitoring requirement, the permittee shall comply with the pro-visions of Section 6.45(b) of the Regulation 6 and submit a copy of any contract made to the Board.

B.

Definitions Unless otherwise stated here, the definitions of Regulation #6 apply 1.

The " average monthly discharge" is the total mass, and concentration in the case of sewage' treatment works, of all daily discharges sampled and/or measured during a calendar month on which daily discharges are sampled and measured, divided by the number of daily discharges sampled and/or measured during any such month. The average monthly discharge limitation may not be violated during such calendar month.

2.

The " average monthly temperature" means the arithmetic mean of measure-ments made on an hourly basis, or the mean value plot of the record of a continuous automated temperature recording instrument, either during a calendar month, or during the operating month if flows are of shorter duration.

The " maximum daily discharge" is the highest total mass of a pollutant discharged during the calendar day or, in the case of a pollutant limited in terms other than mass, the highest average concentration or other measurement of the pollutant specified during the ' calendar day or any 24-hour' period that reasonably represents the calendar day for the purposes of sampling.. The maximum daily discharge limitation may not be violated during any calendar day.

The " average weekly discharge" is the total mass and concentration of all daily. sewage treatment works discharges during any calendar week on which 7

daily discharges are sampled and/or measured divided by the number of daily discharges sampled and/or measured during such calendar week. The average weekly discharge limitation may not be violated during any calendar week.

5.

" Bypass" means the intentional diversion of wastes from any portion of a treatment facility as defined in Section 6.14(m) of Regulation #6.

'6.

" Upset" means an exceptional incident in which there is unintentional and temporary noncompliance with technology-based permit effluent limita-tions because of factors beyond the reasonable control of the permittee as defined in Section 6.14(n) of Regulation #6.

7.

" Composite Sample" means a combination of individual samples taken at selected intervals to minimize the effect of the variability of the individual samples.

8.

" Grab Sample" is an individual samp e collected in less than 15 minutes.

9.

"i-s" (immersion stabilization) means the.isnmersion of a calibrated device in the ef fluent stream until the reading is. stabilized.

10.

The " maximum daily temperature" means the highest arithmetic mean of the temperature observed for any two (2) consecutive hours during a 24-hour day, or during the operating day if flows are of shorter duration.

11.

" Measured flow" - any method of liquid volume measurement the accuracy of which has been previously demonstrated in engineering practice, or for which a relationship to absolute volume has been obtained.

12.

"At outfall XXX" - A sampling location in outfall line XXX downstream from the last addition point or as otherwise specified.

13.

" Estimate" is to be based on a technical evaluation of the sources con-tributing to the discharge including, but not limited to pump capabilities, water meters and batch discharge volumes.

14.

"NL" means no limitations on the affected parameters, however, monitoring is required.

15.

"NA" means effluent limitations and monitoring requirements not required.

16.

"Non-contact cooling water" means water used to reduce temperature which does not come into direct contact with any raw material, intermediate product, waste product (other than heat), or finished product.

  • A." Management Requirements 1.

Change in Discharge All discharges authorized by this NPDES permit shall be made in accordance with the terms and conditions of the permit. All expansions, production increases, or process modification., that will result in new or increased s

discharge (s) of pollutants, must be reported promptly to the Board by submission of a new NPDES application, or, if such discharge (s) does not violate effluent limitations specified in the NPDES permit, by submission to the Board of notice of such new or increased discharge (s) of pollutants.

The discharge of any pollutant more frequently than, or at a level greater than that identified and authorized by this permit, shall constitute a violation of the terms and conditions of this permit.

If this permit is for a discharge from a treatment works that receives waste from an owner other than the permittee, the permittee shall promptly provide notice to the Board of the following:

Any new introduction of pollutants into such treatment works from a.

an establishment, treatment works, or discharge (s) which would be a new source, as defined in this permit, if such source were dis-charging pollutants to State waters.

b.

Any new introduction of any pollutant (s) into such treatment works, which introduction represents a significant increase in the discharge of pollutant (s) to the treat. ment works or may interfere with, pass through, or otherwise be incompatible with such works, from an establishment, treatment works, or. discharge (s), if such establish-mant, treatment works, or discharge (s) were discharging pollutants to State waters; and,

Any substantial change, whether permanent or temporary, in the c.

volume or character of pollutants being introduced into such treat-ment works by an establishment, treatment works, or discharge (s) that was introducing pollutants into such treatment works at the time of issuance of the permit.

Such notice shall include information on:

(1) the characteristics and quantity of effluent to be introduced into such treatment works; (2) any anticipated impact of such change in the quantity of characteristics of I

effluent to be discharged from such treatment works; and (3) any additional information that may be required by the Board.

Any owner proposing a new discharge or new source shall submit an application for a NPDES permit at least 30 days prior to commencing erection, con-struction, or expansion or employment of new processes at any facility.

Within that 30 day period, the Board may prohibit such commencement until the NPDES permit is issued. In no case, however, shall any discharge from said facilities commence prior to the issuance of a NPDES permit.

Treatment Works Operation and Quality Control i

All waste collection, control, treatment and. disposal facilities shall be operated in a manner consistent with the following:.

a.

At all times,_all facilities shall be operated in accordance with the CTO, if applicable, and in a prudent and workman-like manner so as.

to minimize upsets and discharges of excessive pollutants.

b. ' The permittee shall provide an adequate ' operating staff which is duly qualified to carry out the operation, maintenance and testing functions required to insure compliance with the conditions of this permit.

c.

Maintenance of treatment facilities shall be carried out in such a manner that effluent quality requirements are not violated.

d.

Collected residues shall be stored in such a manner as to prevent entry of those wastes (or runoff from the wastes) into State waters, and disposed of in accordance with this permit or other Certificate issued or plans approved by the Board.

3.

Adverse Impact The permittee shall take all feasible steps to minimize any adverse impact to State waters resulting from noncompliance with any effluent limitations specified in this permit, and shall perform and report such accelerated or additional monitoring as is necessary to determine the nature and impact of the noncomplying discharge.

4.

Treatment Facilities Failure In order to maintain compliance with the effluent limitations and prohibi-3-

tions of this permit, the permittee shall:

a.

In accordance with the Schedule of Compliance contained in Part I, or in accordance with the Virginia Sewerage Regulations, if applicable, provide an alternative power source suf ficient to operate the waste-water collection and treatment facilities; or, if no date for implementation appears in Part I, and the Virginia Sewerage Regulations do not apply, b.

Halt, reduce or otherwise control all discharges upon the reduction, loss, or failure of the primary sources of power to the wastewater collection and treatment facilities.

c.

Halt, reduce or otherwise control all discharges upon the reduction, loss, or failure of the treatment facility until the facility is restored or an alternative method or treatment is provided.

'S Structural Stability

The structural stability of any of the units or parts of the facilities herein permitted is the sole responsibility of the permittee and the failure of such structural units or parts shall not relieve the permittee of the responsibility of complying with all terms and conditions of this permit.

6.

Bypassing Any bypass of the treatment facilities herein permitted is prohibited unless:

the bypass is unavoidable to prevent a loss of life, personal injury, a.

or severe property damage; and b.

there are no feasible alternatives to bypass, such as the use of auxiliary treatment facilities, retention of untreated waste facility shutdowns or maintenance during normal periods of equipment down time; and c.

The Board is notified immediately, and as quickly as possible upon discovery of the bypass (if orally notified, then followed by a written submission within five (5) days). Where the need for a bypass is known (or should have been known) in advance, this noti-fication shall be submitted to the Board for approval, if possible, at least ten (10) days before the date of bypass; and

d.

the bypass occurs under conditions determined by the Board to be necessary to minimize adverse effect.,The public shall be notified and given an opportunity to cor.nent on' bypass incidents of significant duration, to the extent feasible.

7.

Conditions Necessary to Demonstration of an Upset An upset shall constitute an af firmative defense to an action brought for noncompliance with technology-based effluent limitations only if the permittee demonstrates, through properly signed, contemporaneous operating logs, or other relevant evidence, that; a.

an upset occurred and that the permittee can identify the specific cause(s) of the

' set; and b.

the facility permitted herein was at the time being operated in a prudent and workman-like manner and in compliance with proper operation and maintenance procedures; and c.

the permittee submitted a notification of noncompliance as required by Part II.A.7 above; and l

the permittee took any measures necessary to minimize adverse impact to State waters.

8.

State Law Compliance with this permit during its term constitutes compliance with the Law and Act except for any standard imposed under Section 307 of the Act for a toxic pollutant injurious to human health.

Nothing in' this permit shall be construed to preclude the institution of any legal action under, or relieve the permittee from any responsibilities, liabilities, or penalties established pursuant to any other State law or regulation or under cuthority preserved by Section 510 of the Act.

9.

Property Rights The issuance of this permit does not convey any property rights in either real or personal property, or any exc'lusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor any infringement'of Federal, State, or local laws or regula-tions.

10.

Severability The provisions of this permit are severable, and if any provision of this permit, or the application of any provision of this permit to any circum-stance, is held invalid, the application of such provision to other circumstances, and the remainder of this permit, shall not be af f ected thereby.

11.

Reapplication for a Permit At least 180 days before the expiration date of this permit, unless permis-sion for a later date has been granted by. the board, the permittee shall submit a new application for a permit.

B.

Responsibilities 1.

Right of Entry The permittee shall allow authorized State and Federal representatives, upon the presentation of credentials:

a.

to enter upon the permittee's premises on which the establishment, treatment works, or discharge (s) is located or in which any records are required to be kept under the terms and conditions of this permit; b.

to have access to and copy at reasonable times any records required to be kept under the teres and conditions of this permit; c.

to inspect at reasonable times any monitoring equipment or monitoring method required in this permit; d.

to sample at reasonable times any discharge of pollutants; and, b

management or discharge facilities required under this permit.

f.

For purposes of this section, the time for in,spection shall be deemed reasonable during regular business hours or whenever.the facility is discharging. Nothing contained herein shall make an inspection time unreasonable during an emergency.

2.

Transferability of Permits This permit may be transferred to another person by a permittee if:

a.

(1) the permittee notifies the Board, in writing, at least 60 days prior to the proposed transfer; (2) a written agreement signed by a11' parties to the transfer, con-taining a specific date for transfer of permit responsibility and coverage between the current and new permittees (including acknowledgement that the existing permittee is liable for viola-tions up to that date, and that the new permittee is liable for violations from that date on) is submitted to the Board; and (3) the Board within 30 days does not notify the current permittee and the new permittee of its intent to modify, revoke and reissue, or terminate the permit or to require that a new application be filed rather than agreeing to the transfer of the permit.

b.

Such a transferred permit shall, as of the date of the transfer, be as fully effective as if it had been is, sued directly to the new permittee.

n.

3.

Availability of Reports All reports pertaining to this permit shall be available to the public.

The Board shall not at any time disclose to any person other than appro-priate officials of the EPA pursuant to the requirements of the Act any secret formulae, secret processes, or secret methods, properly identified and denoted as such, however, other than effluent data used by any owner or under that owner's direction. Such trade secrets transmitted by the Board to EPA will be subject to appropriate Federai rei;ulations governing confidentiality of such information.

4.

Permit Modification and Revocation In accordance with the Board's Regulation 6, this permit may be modified or revoked in whole or in part during its term for cause including, but not limited to, the following:

violation of any terms or conditions of this permit; a.

b.

obtaining this permit by misrepresentation or failure to disclose fully all relevant facts; a change in any condition that requires either a temporary or permanent c.

reduction or elimination of the permitted discharge; or

information that the permitted discharge poses a threat to human health or welfare.

5.

Toxic Pollutants Notwithstanding Part III.B.4 above', if a toxic effluent standard or pro-hibition (including any schedule of compliance specified in such effluent standard or prohibition) is established under Section 307(a) of the Act for a toxic pollutant which is present in the discharge and such standard or prohibition is more stringent than any limitations for such pollutant in this permit, this permit shall be revoked and reissued or modified in accordance with the toxic effluent standard or prohibition and Section 62.1-44.15(5) of the Code of Virginia. Any effluent standard or pro-hibition established under Section 307(a) for a toxic pollutant injurious to human health is effective and enforceable by the time set forth in the promulgated standard, even absent permit modification.

6.

Civil and Criminal Liability Except as provided in permit conditions on " bypassing" (Part III A-6),

" upset" (Part III A-7) and " treatment facilities failure" (Part III A-4),

nothing in this permit shall be construed to relieve the permittee from civil and criminal penalties for noncompliance.

7.

Oil and Hazardous substance Liability Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties to which the permittee is or may be subject under Section 311 of the Act or Sections 62,.1-44.34(1) through 62.1-44.34(7) of the Law.

Staff Comments:

NPDES Permit No. VA 0052451 was issued on 2 June 1977 and expired on 2 June 1982. The terms and conditions of the permit were administratively continued follow-ing expiration.

The permit reissuance process was delayed by numerous revisions to the draft permit, the Toxicant Monitor-ing Program, the 316(a) study requirements and due to EPA's failure to accept the staff's concentration effluent limitations or provide their rationale for requiring mass based effluent limitations. Additional delays were created by a one-third reduction of regional manpower since March 1984.

The discharge is not controversial and is currently meeting the.Lrequired effluent limitations.

The effluent limitations for pH are based on Water Quality Standards while the balance of the parameters are based on Federal Effluent Guidelines.

The staff believes that the attached effluent limita-tions will maintain the Water Quality Standards adopted by the Board.
