Should you have questions regarding these matters, we will be pleased to discuss them with you: 10 CFR 26.24(a) - Revise this section to exclude thosc ir.uividuals who are required to aport to tne Emergoney Operations Facility, but do not make docisions concerning the critical path and/or technical part of plant recovery. Example.1 are: Administrative Support Manager, food seNice, transportation off-site security, Irformation systems (off-site computers, Faxes, and printers), purvisasing, risk management (ANI insurance contract), housing, office furnishings, telecommunications, and other type support personnel. Add a 10 CFR 26.24(a)(5) Infreque-t Access - Test results of individuals returning to the same plant after more than 60 days and less than 365 days, who left under favorable conditions need not have test resuits back from the laboratory prior to reactivation of the individual's protected area badge unless the licensee has reason to believe the individual has abused alcohol or been involved with illegal drugs. l 10 CFR 26.24(d)(2) - Revise this section to permit suspension of an individual's unescorted access pending a confirmed positive or negative by the MRO, based on receipt of a laboratory confirmatory positive for marijuana, cocaine, PCP, or-methamphetamine with positive stereoisomer information. Currently the NRC permits plants who conduct initial testing to make these decisions for marijuana and cocaine based upon 85% or greater accuracy. Accuracy for confirmatory positive results of - these three substences is virtually 100%. There are no medical benefits in the consumption of PCP. There is only one prescribed medication, Eldepryl, wnich would give a dextromethamphetamine. This d;ug is used for Parkinsonism. This would enhance the safety of the individue! and the phnt. 10 CFR 26.71(d) - Revise this section by adding a sentence, "Information concerning negative test results may be discarded after submittal of the six month report." 10 CFR 26.73(a)(2) - Revise this section to specify "on" or off-site" so there is no confusion. 54 FR 24487, Section 15.2.4 is very clear on this, but not 26.73(a)(2). t l 10 CFR 26, Appendix A, Subpart B, Section 2.2(a)- Revise this section to read that " chain-of-custody forms may be destroyed after receipt of negative results from the j labora'.oly." - Page 1 of 2 -
1 10 CFR 26, Appendix A, Subpart B, Section 2.7(m) - Revise this section to clarify that these inspec' ions may be performed by c;ualified I!ceriseo personnel and are separate and distinct from the audits addrossed in to CFR 26.80(b). We will suggest to NUREG that NUREG.1385, Sectlen 7.3, Option 2 delete " training" for individuals who retum to the same site within 365 days of a favorable termination of unescorted access. 2.3 Preventing Subversion of Testing - A concern was raised tnat urine collection bottles with temperature strips attached allowed donors who were bringing in surrogate urine specimens for their specimen to verify that the temperature of the surrogate sample was valid. Additionally, donors have expressed ccqcom that leaving the lid of the collection bottle with the collector left the possibiCly that the collector could tamper with the lid and contaminata the t oecimen. These two concoms have bean rescNed with our primary NIDA laboratory changing its packing method. The bottle with the temperature strip and lid are now packaged in an easily opened bag inside the-collection box. The collection box is opened before the donor goes into the bathroom to ensure all components necessary for the collection are in the box, but the bag is left intact. The donor is given a shrink wrapped sterile urine collection cup that is supplied by the laboratory separately from the collection kits. When the donor gives the - specimen to the collector, the bag containing the bottle with the temperature strip and Ls lid is opened in front of the donor. The specimen is poured into the bottle and ths temp 6tature is measured. The collector then completes the collection process as outlined in BG&E's coliection procedures. 3 1 - Page 2 of 2 - - - _ -}}
