Dear Mr. Chairman:
For some time, the Committee has expressed growing concern that the Nuclear P.egulatory Comission seems unwilling or unable to make timely deci-sions.
I believe this failure by the Commission undermines its effectiveness and credibility and raises questions about the utilization of resources that have been authorized, and appropriated by the United States Congress.
This has been a matter of discussion during our hearings and in comunications to the Commission in the past.
During the hearings on the FY 1985 budget, the Committee made clear its interest in'a timely decision by the NRC on restart of the undamaged TMI-l plant.
As stated in the Committee Riport:
"Over five years have passed since the accident at Three Mile Island and yet the NRC has not been able to reach a decision on the restart of the unaffected TMI-1 plant.
The inability of the NRC to reach a decision on this facility jeopardizes public confidence in the NRC ability to make credible independent decisions. The NRC has Jndicated tliat all litiga-tion and decisions on the restart of THI-l will be completed by June 1984. The Committee expects the NRC to maintain this schedule."
On May 31, 1984, I requested'that you advise the Comittee whether the Commission still intends to maintain the schedule for a decision on TMI-l Restart.

Honorable Nunzio J. Palladino Page 2 On June 15, 1984, you advised that "on June 4 the Commission issued an order to the parties requesting their comments on whether the Commission should lift the effectiveness of the 1979 shutdown order.
The Commission additionally advised the parties that after receiving those coments it would decide as soon as possible whether to lift such effectiveness.
In a sub-sequent order, the Commission gave the parties until July 6,1984 to submit their comments to the Comission. The NRC staff coments are due on July 11, 1984."
On September 11, 1984, the Committee was advised that the NRC will not make a decision on whether or not to lift the TMI-1 shutdown order before it completes its review of the NRC Appeal Board's decision management integrity decisi6n.
Air parties were given twenty days to submit their views on this decision and fifteen days thereafter to submit any reply coments.
The very length of the proceeding over the past 51 years has resulted in an unprecedented volume of information which in itself may now seem to impede making a decision.
f I understand that extensive efforts are now underway in preparation for reopened hearings while the Commission reviews whether such effort is needed at all. This raises the question whether this use of Commission resources in fact contributes to protecting the public health and safety.
I urge the Commission to make a decision on this matter promptly and I would appreciate being advised of your plans to address these concerns.
