Letter from Mr. A. E. Lundvall, Jr., to Mr. J. R. Miller, dated January 31,1985, Request for Amendment Gentlemen:

The Baltimore Gas and Electric Company hereby withdraws Change Number 3 contained in Reference (a), which would have permitted startup with the Control Element Assembly Motion Inhibit (CMI) inoperable, so long as certain remedial actions were implemented.

It is our understanding that even with the remedial actions prescribed in reference (a),

the NRC staff has concluded that a plant startup with the CMIinoperable is considered unacceptable.

Should you have further questions regarding this matter, we would be pleased to discuss them with you.
