Dear Administrative Judges:
LILCO has received today the responses of (1) Suffolk County and New York State and (2) the NRC Staff to LILCO's re-Both newed motion for summary disposition of Contentions 1-10.
pleadings contain new legal arguments to which LILCO believes it important to respond; in addition, the Intervenors' lengthy pleading so significantly distorts the course of proceedings in other forums that correction of the record is necepsary.

HUNTON & WILLIAMS Consequently, absent further guidance from the Board, LILCO will file by Tuesday, March 26, 1985, and sooner if possible, a motion for leave to reply to the NRC and Intervenors' filings,
accompanied by a reply, in accordance with the recent guidance in Louisiana Power & Light Company (Waterford Steam Electric Station, Unit 3), slip op. n.1 (February 13, 1985).
LILCO had previously requested in its February 27, 1985 renewed motion for summary disposition that the Board decide Contentions 1-10 based upon the extensive legal briefs filed by the parties last summer and fall, and include the decision on Contentions 1-10 as part of the opinion scheduled to be issued 4
LILCO continues in April on offsite emergency planning issues.

The resolution of Contentions 1-10 bids fair, how-ever, to take at least a few more weeks.
LILCO thus requests that the Board sever Contentions 1-10 from the remaining of fsite emergency planning issues so that the Board's opinion can be released in April as now scheduled.
