NOTICE OF AVAILABILITY OF THE DRAFT ENVIRONMENTAL IMPACT STATEMENT FOR INTERIM STORAGE PARTNERS PROPOSED CONSOLIDATED INTERIM STORAGE FACILITY LOCATED IN ANDREWS COUNTY, TEXAS (DOCKET NUMBER: 72-1050)

Dear Mr. Isakson:

The U.S. Nuclear Regulatory Commission (NRC) staff has completed the draft Environmental Impact Statement (EIS) for the construction and operation of Interim Storage Partners LLCs (ISPs) proposed consolidated interim storage facility (CISF) for spent nuclear fuel (SNF).

The NRC staff has prepared a Federal Register (FR) Notice of Availability (NOA) to advise the public that the draft EIS is publicly available from the NRCs Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC website at http://www.nrc.gov/readingrm/adams.html. The ADAMS accession number for the draft EIS is ML20122A220. In addition, at its earliest opportunity, the NRC staff plans to make hard copies of the draft EIS available to the public at the following locations: the Andrews County Library, 109 NW 1st Street, Andrews, TX 79714; the Hobbs Public Library, 509 N Shipp St., Hobbs, NM 88240; and the Eunice Public Library, 1003 Ave. N, Eunice, NM 88231.

As discussed in Chapter 2 of the draft EIS, the NRC staffs preliminary recommendation is issuance of an NRC license to ISP to construct and operate a CISF for SNF at the proposed location. This recommendation is based on (i) the license application, which includes ISPs Environmental Report and supplemental documents, and ISPs responses to the NRC staffs requests for additional information; (ii) the NRC staffs consultation with Federal, State, Tribal, and local agencies, and input from other stakeholders; (iii) the NRC staffs independent review; and (iv) the NRC staffs assessments provided in the EIS.

A separate NOA of the draft EIS will be placed in the FR through the U.S. Environmental Protection Agency (EPA). The 120-day public comment period end date is calculated from the date on which the EPA notice is published in the FR. As noted in the NRCs FR notice, the NRC is providing an extended comment period in reaction to the COVID-19 situation.
