Commissioners U.S. Nuclear Regulatory Commission 1717 H Street, N.W.

Washington, D.C. 20555

Dear Commissioners:

As a Suffolk County Legislator I would request that the NRC hold a public proceeding on the Shoreham low power issue so that the interests of the residents of Suffolk County may be fully represented.

Heretofore, the Commission has considered a low power license only when there has been no outstanding issues which could preclude the issuance of a full power license. In the Shoreham case, the emergency preparedness contentions remain unsolved. Under such circumstances, how can the Commission grant a low power license for Shoreham? How can the Commission contemplate this matter in the absence of public input?

Shoreham is too important a case for the NRC to give the people of Suffolk County anything less than the fullest and fairest opportunities to present their case. The people of Suffolk County should not be denied the right to present an argument against the issuance of a lower power license for Shoreham, i
