LEA REOUEST FOR SUBp0ENAS AND FILINC OF TESTIMONY ON NOV. 2, 1984

Dear AdminidtratIve Judges,

The , copies of LEA's filing of off-site emergency planning testimony on admitted contentions made on November 2, 1984 which were hand delivered to the Board, the NRC Staff and Mr. Troy Connor, Counsel for the Appilcant did not contain the enclosed request for a subpoena to obtain the testimony of,Hr. John Waters, Emergency Manager and Fire Marshall for Lower Merion Township, Montgomery

. County, in relation to contention LEA-24. This item was included in the list submitted with LEA's testimony on the bo t tom uitdo r the heading, ' subpoenas requested for LEA-24'. All other copies of.the filing did include the enclosed Motion to the lioard. The same also applies to the enclosed r.cwsci1pping which had been previously served on all parties during discovery, which LEA intended to attach to its request for a subpoena to obtain testimony from Superintendent Dr.

Thomas Persing (Upper Perkiomen School District).

LEA wishes to emphasize that it made overy possible effort to obtain written testimony from all those it has requested subpoenas for, but was unable to obtain anything not included in its filing without a subpoena from the llo a r d .
