APPLICANTS' RENEWED REQUEST FOR EXTENSION OF FILING DEADLINE 3
c, On November 2, 1984 the Licensing Board issued a Memorandum (Attorney-Dictated Testimony) requiring the Applicants to discuss certain matters concerning the appropriateness of counsel s
dictating draft' testimony.
The Memorandum was served on November
- i' 5,
1984 and arrived at the offices of Applicants' counsel the following day at noon.
The Memorandum specified that Applicants were to respond to it by November 6.
On Friday, November 2, Applicants' counsel, Mr. Bruce Downey, spoke by telephone with the Licensing Board Chairman, during which time the Chairman stated that a Memorandum along the Llines of that issued on November 2 would be forthcoming.
Mr.
Downey indicated-that he'would attempt to prepare a response t
l before he was to leave _ town the following Monday on other
-t business.
He was, however,' unable to do so.
Undersigned counsel W
y, mso c
were unaware of this conversation until late in the afternoon of November 6, after Applicants' Request for Extension of Filing Deadline was filed.
Accordingly, Applicants hereby renew their request for an extension of time until Thursday, November 8, 1984 by which to respond to the Memorandum.
Applicants were unaware of the November 6, 1984 deadline until noon of that day, when the Memorandum arrived at the offices of Applicants' counsel.
For this reason, good cause exists for granting the extension of time.
Further, no party will be prejudiced should the extension be granted.
Respectfully submitted, McNefll Watkins, II Sanford L. Hartman BISHOP, LIBERMAN, COOK, PURCELL & REYNOLDS 1200 Seventeenth Street, N.W.
