LILCO'S MOTION TO STRIKE PORTION OF STAFF SUPPLEMENTAL BLOCK TESTIMONY In the Supplemental Testimony of Spencer H.
Bush and Adam J.
Henriksen concerning cylinder blocks, the following statements are made by Staff consultant Bush:
Q.. Do you believe the evidence per-mits a conclusion that the cam gallery cracks are resolved?
A.

Not necessarily.
Under Section III of the ASME Code, such crack-like defects in safety-related components of nuclear power systems would be required to be removed.
This applies to
" active" nuclear components such as pumps,-as well as to " passive" components such as piping.
ASME Section III is not applicable to emergency diesel generators.
(Emphasis added.)
This testimony is, by its own terms, neither relevant nor material and therefore contravenes the regulatory standard for admissibility set forth in 10 CFR S 2.743(c).
Accordingly, this testimony should be stricken.
