No correspondence coussanication or statement whether verbal, f

I writtaa, or ottervise, and whether originated by CCITJ,ACTCt or by CurII, shall be deemed to affect. alter. or amend this contract in any manner, unless written consent thereto has been obtained from CWNE1*S Materials Management Department. (hereis T ).

I 3.

A copy of all written correspondence between CCNTRACTCt and CWIM shall be filed with MMD. Such filing shall not constitute the written consent required in the foregoing paragraph.

ARTICLZ II. CONT 1ULCTCt RZ7RISTNTATTYE (7 78)

CCNIZACTOR shall designate to CVNQ in writing and keep on the VC1Z at all cines during, its progress a cospetent resident saperistcudent, who shall not be replaced without prior writtes notice to and writtes consent of CUNER except under extraordinary circumstancey The superintendent shall be CCNTRACTC1'S agent and shall have authority to act o.: behalf of CCNTRACTCt in all matters relating te this Contract.

All commannications given to the superintendent shall be deemed to be given to CCNIZACC1.

ARTICLE ITI. INTrtFRETATICW (7 73)

A.

The CCNTRACT DCCQE3TS are couplementary, and what is required by any one shall be as binding as if required by all.

It is intended that UC1K not specifically covered under any heading, section, branch, class or division of the CONTRACT DCC::MENTS but reasonably inferable as necessary to produce the intended resnits shall be supplied by CCNTRACTCt as part of this contract unless it is specifically required to be prurided by CENEZ or others.

A.

CCNTRACTC1 warrants the VCEE and all portions thereof to be free of defects is workmanship and meterial, and to be fit for its intended use, as set forth hereia, for a period of years from the date of CWNE1*5 final acceptance. Further.

CCNTRACTC1 warrants that the VCRE will fully conform to all the requirements of the CONTRACT DCCDfENT3.

I 3.

In all events of non-coup 11ance with the aforesaid warreaty.

CCNTRACTC1 shall at its awa expense repair and/or replace any and all defective parts. Such repair / replacement includes, but is not limited to, reserval and installation. De warranty covering

all VCRI to be replaced or repaired by CONTRAC*,01 shall be reinstated on the repaired / replaced porties for a period of years from the date whos such warranty work is e.:cepted by CWEE1.

The performance of 90'4I any be suspended, from time to time in whole or in part, by CWNIX for its own convenience in accordance with this clause. Suspension of WORI shall be effected by delivery to CCNTRACTC1 of a Notice of Suspension specifying the extent to which performance of WORI is suspended, and date upos which such suspension becomes effective.

(3) fires, floods, explosions or other catastrophes. (4) 'pidemics and quarsatine restrictions. (5) freight *mbargoes. (6) unusually severe vescher.

(7) delays of a supplier due to the foregoing or (8) causes which could amt have been reasonably anticipated and which are beyond the control and without the fault or negligence of CONTRACICE.
