NRC Safety Evaluation to T. J. Kovach from R. M. Pulsifier dated June 23,1997 The purpose of this letter is to confirm receipt of your Safety Evaluation approving the use of Category 3 !nstrumentation for accumulator level and pressure and to finalize the Commonwealth Edison (CECO) commitment regarding these instruments.

Reference letter (a) provided the Commonwealth Edison Compliance report to Regulatory Guide 1.97, revision 3. In this report CECO provided justification for compilance with the regulatory guide based on an exception request to reduce the qualifications from a category 2 to a category 3 classification. The NRC staff has reviewed the bases for these exceptions and has concluded that these instruments do not perform any post accident safety function and its nualification can be reduced to Category 3.

Based on the reference (b) Safety Evaluation approving the use of the Category 3 classification, the Byron and Braidwood accumulator level and pressure instruments are in compliance with the regulatory guidance and no further action is required.
