ThefollowingMembersoftheEddyLeaEnergyAllianceincluding;CityofCarlsbad,CityofHobbs,Eddy County,LeaCountyallinNewMexico,theirelectedmembersoftheircouncilsandcommissionsaswell astheeightboardmembersoftheEddyLeaEnergyAllianceallwanttobeastransparentas possible.Tobesurewe,aswellastheNRCandHoltecareanxioustobepresentedwithanyscientific, evidencedbasedinformationdispellingthefindingsoftheDEIS.

Sofar,allthathasbeenpresentedbythosethatopposetheprojectarenontechnicalemotional attitudeswithnorealbasisfortheiropposition.

Itisclearthoseopposingtheprojectaredoingitfornootherreasonthandelay.Askingforextensions andusinganymotivetheyareabletoconceivetodelaytheEISprocessisanormal,old,tiredtactic.We wouldsubmittoyouthefollowingpointsrelatedtothehearingprocess:

Anextendedperiodforcommentforanother60daysupto120daysseemsreasonable providedtheNRCdoesnotbelievethisextensionwillcausedelay.

Publichearingsviatelecommunicationsorothersuchmediumplatformsaremuchmore effectivethanpublichearingsinpersonforanumberofreasons:

Thesamepeopleareonlyabletospeakonceandtheyarenotabletocrowdoutthe localswherethehearingisproposed,whichistohearfromthelocalpopulation.

Thoseopposingtheprojectmovefromhearinglocationtohearinglocationsayingthe samethingoverandoveragainandthenclaimtohavethislargenumberopposingthe projectwhenthereareonlyafew.

Theinpersonpublichearingsaremadeintoacircusbythoseopposingtheprojectwith blowups,teeshirts,songs,chants,booing,clappingandmanyotherdemonstrations thathavenothingtodowiththeseriousnessoftheprojecthearings.

Andfurthermore,electronicmediumhearings:

ProvideforamuchbroaderpossibilityforcommentsfromamuchlargerNewMexico platform.

Thevenuewouldmeanpeoplepresentingwouldbeseriousandspendmoretime preparingtheirremarks.

Thenatureofthevenuecreatesaseriousattitudebythosepresentingtoprovide technicalinformation,ratherthanembarrassingthemselveswithcommentsthathave nobasisforopposingtheproject.

ThemanycomplaintsregardingtransportationarenotrelevanttotheDEISotherthan the4milerailspur.

Legaltheoryargumentscanbemadewithpropercitationssubmittedasappropriate presentationsbyemail.

We,therefore,stronglyrecommendtheNRCestablishdatesforthepublicinpersonhearingsthatcan befocusedonthepreviousfivespecificareasofNewMexicotogivethoseresidentsampleopportunity toexpresstheirsupportorconcernsfortheprojectthoughatelecommunicationplatform.Since transportationisnotpartoftheapplicationotherthanthe4milespurtotheprojectlocation.

Therefore,wewouldassertanationalcommenthearingwouldbeinappropriateanduncalledfor.

ThosethatarewritingyouinhopesofdelayingtheEISprocessareverysophisticatedpolitical operationalorganizations,and,frankly,theyhavenobasisforcomplainingthattheirmembersare unabletoaccessanonlinehearingprocess.Argumentstheyhavenointernetaccessorcantafforditis specious,tosaytheleast,whentheyseemtobeabletoattendmeetingsasfaras400milesawayfrom theirhomebaseswithnofinancialdistress.Wewouldaskthatyoumoveforwardwithyourprocess expediouslyinorderforyoutoreceivecommentsandcompletetheEIS.
